Military member impersonation misdemeanor penalty passed by House

Someone looking sharp in a military uniform or donning battle fatigues may not have armed forces experience. And they could be sporting the apparel for less-than-honest intentions.

Rep. Jeff Howe (R-Rockville) sponsors HF2554 that would expand current law to make it a misdemeanor to falsely impersonate an active or reserve component military service member or a veteran with the intent to mislead another person. Under current law, it is a misdemeanor to impersonate a military officer with intent to mislead.

Passed 127-1 by the House Friday, the bill goes to the Senate where Sen. Bruce Anderson (R-Buffalo) is the sponsor.

“We’re very concerned that during a state active duty it would be very easy for someone or some group to start a checkpoint somewhere and impersonate members of the National Guard on state active duty providing some sort of security or other necessary duty in the event of an emergency,” Don Kerr, executive director of the Military Affairs Department, told the House Veterans Affairs Division in March.
