Property owners denied driveway access to a state highway would be able to appeal the Department of Transportation’s ruling in district court under a bill passed, as amended, 90-37 Monday by the House.
HF2014 proposes to allow applicants who are denied a driveway permit to access a trunk highway directly from private property to challenge the decision in district court. It would also place the burden of showing that the permit denial is necessary on MnDOT.
Current law allows for access to land that neighbors a highway, but driveways are subject to MnDOT regulation based on potential interference with construction, maintenance or safe use of the roadway.
Bill sponsor Rep. John Petersburg (R-Waseca) said the legislation will offer property owners due process to have their objections heard.
The bill now goes to the Senate, where Sen. Rod Skoe (DFL-Clearbrook) is the sponsor.
