Court ruling in Illinois could be felt in our state

Dear Neighbor,

 

The U.S. Supreme Court’s ruling today regarding an Illinois case could have significant implications on unionization of childcare providers in Minnesota.

 

The court ruled in a 5-4 decision that homecare workers in Illinois are not public employees and therefore cannot be compelled to join a public employee union and/or pay union dues.

 

Minnesota’s childcare unionization law was on hold as the Illinois case unfolded. With the Illinois case now settled, the courts in Minnesota can be expected to consider this precedent and apply the ruling to public unionization of childcare providers in our state.

 

This is a big win for parents who were concerned unionization would drive up childcare costs. It also is a victory for providers who were concerned they would have to join a union over their objections, raise prices or turn away children from families of lesser means.

 

We will keep an eye on this situation as we await a ruling in Minnesota, especially the situation here is nearly identical to the one in Illinois. This also could be applied to care attendant unionization in our state.
