MINUTES

Representative Gottwalt, Chair, of the Health and Human Services Reform Committee, called the meeting to order at 3:37 P.M. on April 27, 2011, in Room 200 of the State Office Building.

The Committee Legislative Assistant noted the roll.

HF 1475 (Lanning) Children and family services provisions technical and policy changes made, MFIP and child care assistance program changes made, MFIP and diversionary work program simplified, and child support provision changed.

Representative Gottwalt moved that HF1475 be recommended to pass and be referred to the General Register.

Representative Gottwalt moved the HF1475A2 amendment. THE AMENDMENT WAS ADOPTED.

Representative Fritz moved to orally amend HF1475 by: "delete" L., 13.30 thru P.14, L.14.34. Reinstate the old language and renumber. THE ORAL AMENDMENT WAS ADOPTED.

Representative Gottwalt moved that HF1475, as amended, be recommended to pass. THE MOTION PREVAILED.

HF1498 (Liebling) Human services agency provisions modified, agency hearing and appeals provisions modified, and Disparities Reduction Advisory Council created.

Representative Liebling moved that HF1498 be recommended to pass and be sent to the General Register.

Representative Gottwalt orally moved to "delete" Article 2 THE MOTION PREVAILED.

Representative Liebling moved the H1498A2 amendment. THE AMENDMENT WAS ADOPTED.

Representative Quam moved the flowing oral amendment: L. 6.6, 6.9, 6.12., 5.29, "delete" judge and "insert " referee, 6.13 "delete" referee and "insert" judge THE MOTION PREVAILED.

Representative Liebling moved that HF1498, as amended be recommended to pass and be sent to the General Register. THE MOTION PREVAILED.

HF1404 (Franson) Gager's Law enacted, and standards adopted that govern outdoor activity at licensed child care facilities.

Representative Gottwalt moved that HF1404 be recommended to pass and go to General Register.

Representative Franson moved to orally amend HF1404 by: L., 1.9, "delete" All, "delete" engage in outdoor activities and "insert" play outdoors.

Testifying on HF1404 were Representative Franson and Kari Akers.

Representative Gottwalt moved that HF1404 be laid over. THE MOTION PREVAILED.

HF523 (Quam) Children and Community Services Act service plan requirements changed.
Representative Quam moved that HF523 be recommended to be laid over for inclusion in the Health and Human Services Reform bill.

Testifying on HF523 was Representative Quam.

Representative Quam renewed his motion that HF523 be recommended to be laid over for inclusion in the Health and Human Services Reform bill. THE MOTION PREVAILED.

Representative Mack assumed the gavel at 4:02 P.M.

HF1020 (Gottwalt) Nursing facility rate equalization phased out.

Representative Gottwalt moved that HF1020 be recommended to pass and be sent to The General Register.

Representative Gottwalt moved the H1020DE2-1 amendment.

The meeting was recessed at 4:17 P.M.

Representative Norton moved that the minutes of April 26, 2011 be approved. THE MOTION PREVAILED.

Representative Gottwalt renewed his motion that the H1020DE2-1 amendment be adopted. THE MOTION PREVAILED.

Representative Gottwalt moved the H1020A1 amendment. THE AMENDMENT WAS ADOPTED.

Representative Gottwalt moved the H1020A3 amendment. THE AMENDMENT WAS ADOPTED.

Representative Gottwalt moved the H1020A7 amendment. THE AMENDMENT WAS ADOPTED.

Representative Mack moved the H1020A2-1 amendment with the following oral amendment: P 6, L.6.3thru 6.8, "delete" all new language. THE AMENDMENT, AS ORALLY AMENDED WAS ADOPTED.

Representative Mack moved the H1020A6 amendment. THE AMENDMENT WAS ADOPTED.

Representative Gottwalt moved to amend the H1020DE2-1 amendment by: "delete" all changes to Section 10, L.20.8 to L.23.18 THE ORAL AMENDMENT WAS ADOPTED.

Representative Mack moved the H1020A11-0350 amendment.

Representative Liebling requested a roll call and the results were as follows:

Voting AYE were; Representatives Gottwalt, Mack, Barrett, Benson, Franson, Fritz, Gruenhagen, Hosch, Kiffmeyer, Lohmer, McElfatrick, Quam
Voting NAY were Representatives Liebling, Loeffler, Moran, Murphy, Norton

On a vote of 12 AYES and 5 NAYS THE AMENDMENT WAS ADOPTED.

Representative Gottwalt moved the H1020A11-352 amendment.

Representative Liebling requested a roll call and the results were as follows:

HF1500 (Anderson,D.) Chemical and mental health services changes made, and rate reforms made.

Representative Gottwalt moved that HF1500A1 be recommended to pass. THE AMENDMENT WAS ADOPTED.

Representative Gottwalt moved the H1500A2 amendment. THE AMENDMENT WAS ADOPTED.

Representative Loeffler moved to orally amend HF1500 by: P.2, l.2.26 after conducted "insert" or upon receiving court approval after a finding that such a screening would be in the best interest of the child. THE ORAL AMENDMENT TO THE AMENDMENT WAS ADOPTED.

Representative Liebling moved that HF1500, as amended, be re-referred to the committee on Judiciary Policy and Finance. THE MOTION PREVAILED.

HF1508 (Schomacker) Resident case mix classification changed.

Representative Gottwalt moved that HF1508 be recommended to pass and be sent to the General Register.

Testifying on HF1508 were: Representative Schomacker and Marci Martinson, Minnesota Department of Health.

Representative Gottwalt renewed his motion that HF1508 be recommended to pass and be sent to the General Register. THE MOTION PREVAILED.

HF1543 (Gottwalt) Health care program provisions changed; technical and policy changes made; obsolete language clarified; federal conformity changed; eligibility requirements clarified; pharmaceutical provisions modified; covered services clarified; elderly waiver payment eliminated; right to appeal and appeal processes provided; provider requirements imposed; nonemergency medical transportation report required; and managed care and county-based purchasing data report required.

Representative Gottwalt moved that HF1543 be recommended to pass and be sent to the General Register.

Representative Gottwalt moved the H1543A-1 amendment.

Representative Gottwalt moved to orally amend the H1543A1 amendment by: P.1 l.7 "delete" everything after restrict and "insert" the number of patients served based on coverage under a state. THE ORAL AMENDMENT WAS ADOPTED.

Representative Loffler moved to orally amend the H1543A1 amendment oral P. 2, L.2.9 after counties "insert" including a metropolitan and rural county representative. THE ORAL AMENDMENT WAS ADOPTED.

Representative Gottwalt moved the H1543A1 amendment, as amended, be adopted. THE MOTION PREVAILED.

Representative Gottwalt moved to orally amend HF1543 by "delete" P. 26, L.26.27 thru P.27, L. 27.13. THE ORAL AMENDMENT WAS ADOPTED.

Representative Gottwalt moved to orally amend HF1543 by: (d) this subdivision applies to medical assistance services delivered for fee for services and does not apply to services delivered thru managed care and county based purchasing plans. THE ORAL AMENDMENT WAS ADOPTED.

Representative Gottwalt moved to orally amend the H1543A2 amendment by: P. 1, L. l. l5 after the word stands "insert" and the vendor serves primarily pediatric patients. THE ORAL AMENDMENT WAS ADOPTED.

Representative Gottwalt moved that HF1543A2 amendment, as amended, be adopted. THE MOTION PREVAILED.

Representative Gottwalt moved to orally amend HF1543 by: P. 16 L.18 "delete" for, P. 16, P.16, L.19 "delete" which and "insert" that, P.29, L29.28 after cause "insert" not. THE ORAL AMENDMENT WAS ADOPTED.

Representative Loffler moved to orally amend HF1543 by: L.17.27 ‘delete" thru 17.33 and "insert" with (d) Durable medical equipment means a device or equipment that: can withstand repeated use; is generally not useful in the absence of an illness, injury, or disability; and is provided to correct or accommodate a physiological disorder or physical condition or is generally used primarily for a medical purpose

Representative Gottwalt moved to orally amend HF1543 by: P. 16, L.16.2 after drug "insert" or medical,
16.28, after drug "insert" or medical, L.30 after drug "insert" or medical THE ORAL AMENDMENT WAS ADOPTED.

Representative Gottwalt moved to orally amend HF1543 by: "delete" all of Article 9. THE ORAL AMENDMENT WAS ADOPTED.

Representative Gottwalt moved to orally amend HF1543 by: "delete" L. 34.6 thru L. 34.7 THE ORAL AMENDMENT WAS ADOPTED.

Representative Abeler moved to orally amend HF1543 by: "delete" all of article 14, P. 20 thru P. 23. THE ORAL AMENDMENT WAS ADOPTED.

Representative Mack moved that HF1341 be recommended to pass and be sent to the General Register.
