GOVERNMENT OPERATIONS AND ELECTIONS

MINUTES

Representative Peppin Chair of the Government Operations and Elections Committee, called the meeting to order at 10:30 a.m. on Wednesday, April 27, 2011 in Room 5 of the State Office Building.

The Committee Legislative Assistant noted the roll.

A quorum was present.

Representative Quam moved approval of the minutes from April 26, 2011. THE MOTION PREVAILED AND THE MINUTES WERE APPROVED.

H.F. 705 (Crawford) Counties permitted to perform private audit meeting standards of state auditor, federal single audit permitted for cities and counties, mandated reporting eliminated, alternative Web site publication provided, et cetera.

Representative Murray moved that H.F. 705 be recommended to pass and re-referred to the Judiciary Committee.

Representative Murray moved the H0705DE1-1 amendment. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Representative O’Driscoll moved the H0705A1 amendment to the H0705DE1-1 amendment, with the following oral additions incorporated:
Page 6, Line 8 delete "326b.145;"
Page 6, Line 9 delete "375.17, subdivision 3;"
THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED AS MODIFIED.

Representative Murray renewed his motion that H.F. 705 be recommended to pass and re-referred to the Judiciary Committee. THE MOTION PREVAILED, H.F. 705 WAS RECOMMENDED TO PASS, AS AMENDED, AND RE-REFFERRED TO THE JUDICIARY COMMITTEE.

Representative Murray assumed the gavel at 11:40 a.m.
Chair Peppin assumed the gavel at 11:45 a.m.

H.F. 7 (Drazkowski) Local government mandates abolished.

Representative Beard moved that H.F. 7 be recommended to pass and re-referred to the Judiciary Committee.

Representative Beard moved the H0007DE2 amendment with the following oral modifications incorporated:
Page 5, Line 2 delete "326B.145;"
THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED AS MODIFIED.

Representative Nelson moved to amend H007DE2 as follows:
Page 5, Line 4, before "395.24" insert "and"
Page 5, Line 4, delete ";and 471.6161,"
Page 5, Line 5, delete "subdivision 5"

Representative Nelson requested a roll call vote:

Representative Winkler moved the H0007A3 amendment and requested a roll call vote:

ON A VOTE OF 6 AYES AND 7 NAYS, THE MOTION DID NOT PREVAIL, AND THE AMENDMENT WAS NOT ADOPTED.

Representative Sanders moved the H0007A2 amendment.
Representative Greene moved to amend the H0007A2 amendment as follows :
Page 1, line 8, before the period insert ", and the legislature shall appropriate an amount from the general fund to the secretary of state to cover those costs"
Sanders moved to modify the Greene oral amendment so it would read ", and an amount sufficient to pay the costs of reimbursements is appropriated from the general fund in fiscal year 2012 to the secretary of state" Rep. Greene accepted the modification and incorporated it as her oral amendment.
Representative Greene requested a roll call vote on her oral amendment to the amendment:

Representative Beard renewed his motion that H.F. 0007 be recommended to pass, as amended, and re-referred Judiciary Committee. Representative Winkler requested a roll call vote:

ON A VOTE OF 7 AYES AND 6 NAYS, THE MOTION PREVAILED, AND H.F. 7 WAS RECOMMENDED TO PASS, AS AMENDED, AND RE-REFERRED TO THE JUDICIARY COMMITTEE.

The Committee recessed at 12:35 p.m.
The Committee reconvened at 1:15 p.m.

H.F. 495 (Garofolo) Agreement Among the States to Elect the President by National Popular Vote enacted.

Representative Simon moved that H.F. 495 be recommended to pass and placed on the General Register.
