MINUTES



Representative Carlos Mariani, Chair of the K-12 Education Policy & Oversight Committee, called the sixteenth meeting to order at 8:32 AM on Thursday, February 19, 2009 in the basement hearing room of the State Office Building.

The Committee Legislative Assistant noted the roll:

Chair Mariani resumed testimony on HF439.

HF439 (Norton) - A bill for an act relating to education; requiring statewide academic standards for physical education; amending Minnesota Statutes 2008, sections 120B.021, subdivision 1; 120B.023, subdivision 2; 120B.024.

Rep. Norton moved the A09-0047 amendment.

Questions and discussion followed.

Rep. Norton withdrew A09-0047 as staff worked out language to address concerns by the committee and author.

Testifying against HF439, as amended, was:

Rep. Norton moved the A09-0047 amendment.

Rep. Norton incorporated the following changes to the A09-0047 amendment:

Page 1, Line 8, after "grade" insert: "after "later" insert "but is a requirement for graduation for students entering the 9th grade in the 2009-10 school year and later"

THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Abeler moved the A08-1684 amendment.

Rep. Abeler incorporated the following changes to the A08-1684 amendment:

Page 1, Line 1, after "amend" delete "S.F. No. 3001, the first unofficial engrossment," and insert "HF439, as amended by the committee,"
Page 1, Line 3, delete "15" and insert "2" and delete "8" and insert "32"
Page 1, Line 4, delete "5" and insert "2"
Page 2, Line 7, delete "to determine if" and insert "showing that"
Page 2, Line 8, delete "their"
Page 2, Line 9, delete "standards" and insert "standard"

THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Norton renewed her motion that HF439, as amended, be recommended to pass and referred to the Committee on Finance, with a recommended re-referral to the K-12 Finance Division. THE MOTION PREVAILED.

HF523 (Bigham) – A bill for an act relating to education; modifying school background check requirements relating to disciplinary actions; amending Minnesota Statutes 2008, section 123B.03, subdivision 1a.

Chair Mariani moved HF523 be recommended to pass.

Rep. Bigham presented HF523.

Testifying against HF523 was:

Ms. Jan Alswager, Education Minnesota

Chair Mariani laid over HF523 for possible inclusion in the K-12 Education Policy & Oversight Policy Omnibus bill.

Due to time constraints, HF106 will be heard on a later date.

The meeting was adjourned at 10:08 AM.
