MINUTES


Representative Gene Pelowski, Chair of the State & Local Government Operations, Reform, Technology and Elections Committee, called the meeting to order at 8:30 A.M. on Tuesday, March 2, 2010, in Room 200 of the State Office Building.

The Committee Legislative Assistant noted the roll.

Representative Poppe moved that the minutes of February 25, 2010, be approved. THE MOTION PREVAILED.

Continuation of HF2899, as amended (see attached H2899DE1) previously adopted on 2/25/10.

Chairman Pelowski moved that HF2899, as amended, be recommended to pass and re-referred to the Committee on Civil Justice.

Chairman Pelowski moved to amend HF2899, as amended (see attached H2899A4). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Chairman Pelowski presented HF2899 (Pelowski), as amended, a bill for an act relating to data practices; providing an administrative remedy for certain data practices and open meetings law violations; providing civil penalties; appropriating money; etc.

Representative Buesgens moved to amend HF2899, as amended, as follows:

Page 6, line 5, delete "less $50, "

THE MOTION FAILED.

Chairman Pelowski renewed the motion that HF2899, as amended, be recommended to pass and re-referred to the Committee on Civil Justice. THE MOTION PREVAILED.

Representative Winkler moved that HF3111 be recommended to pass and sent to the General Register.

Representative Winkler moved to amend HF3111 (see attached H3111DE1).

Representative Winkler moved to incorporate a technical amendment to amendment H3111DE1, as follows:

Page 9, line 9, reinstate the stricken language

THE MOTION PREVAILED. THE AMENDMENT, AS AMENDED, WAS ADOPTED.

Representative Winkler presented HF3111 (Winkler), as amended, a bill for an act relating to elections; requiring use of a ballot board to process absentee ballots; permitting absentee ballots to be counted starting on the fourth day prior to an election; modifying other absentee ballot processing procedures; amending Minnesota Statutes 2008, sections 201.061, subdivision 4; etc.

Representative Winkler renewed the motion that HF3111, as amended, be recommended to pass and sent to the General Register. THE MOTION PREVAILED.

The meeting was adjourned at 9:32 A.M.
