MINUTES


Representative Gene Pelowski, Chair of the State & Local Government Operations, Reform, Technology and Elections Committee, called the meeting to order at 8:30 A.M. on Wednesday, February 24, 2010, in Room 200 of the State Office Building.

The Committee Legislative Assistant noted the roll.

Representative Poppe moved that the minutes of February 23, 2010, be approved. THE MOTION PREVAILED.

Representative Poppe moved adoption of the Local Government Division report for HF162, First Committee Engrossment. THE MOTION PREVAILED AND THE DIVISION REPORT WAS ADOPTED.

Chairman Pelowski moved that HF162, First Committee Engrossment, be recommended to pass and sent to the General Register.

Representative Hansen presented HF162, First Committee Engrossment (Hansen), a bill for an act relating to waters; modifying drainage system provisions; amending Minnesota Statutes 2008, sections 103B.101, by adding a subdivision; etc.

Chairman Pelowski renewed the motion that HF162, First Committee Engrossment be recommended to pass and sent to the General Register. THE MOTION PREVAILED.

Representative Poppe moved adoption of the Local Government Division report for SF2309. THE MOTION PREVAILED AND THE DIVISION REPORT WAS ADOPTED.

Representative Peterson presented SF2309 (Peterson), a bill for an act relating to local government; lengthening probationary period for newly hired peace officers in certain statutory cities; amending Minnesota Statutes 2008; etc.

Representative Poppe moved adoption of the Local Government Division report for HF2729. THE MOTION PREVAILED AND THE DIVISION REPORT WAS ADOPTED.

Chairman Pelowski moved that HF2729 be recommended to pass and sent to the General Register.

Representative Slocum presented HF2729 (Slocum), a bill for an act relating to local government; permitting certain metropolitan area local governments to impose response time residency requirements upon firefighters.

Representative Poppe moved adoption of the Local Government Division report for HF2797, First Committee Engrossment. THE MOTION PREVAILED AND THE DIVISION REPORT WAS ADOPTED.

Representative Hilty moved HF2797, First Committee Engrossment, be recommended to pass and sent to the General Register.

Representative Hilty presented HF2797, First Committee Engrossment (Hilty), a bill for an act relating to local government; authorizing federally recognized Indian tribes to participate in joint powers agreements; amending Minnesota Statutes 2008, section 471.59, subdivision 1.

Representative Poppe moved adoption of the Local Government Division report for HF3017. THE MOTION PREVAILED AND THE DIVISION REPORT WAS ADOPTED.

Chairman Pelowski moved that HF3017 be recommended to pass and re-referred to the Committee on Commerce and Labor.

Representative Atkins presented HF3017 (Atkins), a bill for an act relating to local government; authorizing municipalities to permit certain solicitations; proposing coding for new law in Minnesota Statutes, chapter 465.

Chairman Pelowski renewed the motion that HF3017 be recommended to pass and re-referred to the Committee on Commerce and Labor. THE MOTION PREVAILED.

Representative Poppe moved adoption of the Local Government Division report for HF418, First Committee Engrossment. THE MOTION PREVAILED AND THE DIVISION REPORT WAS ADOPTED.

Chairman Pelowski moved that HF418, First Committee Engrossment, be recommended to pass and sent to the General Register.

Representative Gardner presented HF418, First Committee Engrossment (Gardner), a bill for an act relating to noxious weeds; allowing municipalities to adopt ordinances for the control of buckthorn; amending Minnesota Statutes 2008, section 18.78, by adding a subdivision.

Representative Gottwalt moved to amend HF418, First Committee Engrossment, as follows:

Page 1, line 10, delete "and private"

Representative Gottwalt requested a roll call vote on the motion.

Voting aye: Anderson, P., Buesgens, Gottwalt, Kiffmeyer, Lanning and Sanders

Voting nay: Pelowski, Hilty, Hornstein, Kahn, Marquart, Nelson, Poppe, Simon and Sterner.

There were 6 ayes and 9 nays. THE MOTION FAILED.

Chairman Pelowski renewed the motion that HF418, First Committee Engrossment , be recommended to pass and sent to the General Register. THE MOTION PREVAILED.

Representative Poppe moved adoption of the Local Government Division report for HF2945. THE MOTION PREVAILED AND THE DIVISION REPORT WAS ADOPTED.

Chairman Pelowski moved that HF2945 be recommended to pass and re-referred to the Committee on Commerce and Labor.

Representative Mahoney presented HF2945 (Mahoney), a bill for an act relating to the State Building Code; modifying municipal enforcement provisions; amending Minnesota Statutes 2008, section 326B.121, subdivision 2.

Representative Kiffmeyer moved to amend HF2945 as follows:
