Representative Carlson, Chair of the Finance Committee, called the meeting to order at
9:34 A.M. on Thursday, April 8, 2010, in Room 200 of the State Office Building.

Vice-Chair Benson moved approval of the minutes of Wednesday, April 7, 2010. THE MOTION PREVAILED. THE MINUTES WERE APPROVED.

Rep. Rukavina moved adoption of the Higher Education and Workforce Development Policy and Finance Division Report for HF0737, First Committee Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Rep. Rukavina moved that SF1246, First Engrossment be recommended to pass and placed on the General Register.

Rep. Rukavina presented SF1246, First Engrossment (Rukavina) Rehabilitation counselors for the blind certification provided.

Rep. Rukavina renewed the motion that SF1246, First Engrossment be recommended to pass and placed on the General Register. THE MOTION PREVAILED.

Rep. Rukavina moved adoption of the Higher Education and Workforce Development Policy and Finance Division Report for HF2781, Second Committee Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Rep. Rukavina moved that HF2781, Second Committee Engrossment be recommended to pass and re-referred to the Committee on Ways and Means.

Rep. Rukavina moved to amend HF2781, Second Committee Engrossment. (See attached amendment H2781A18). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Obermueller presented HF2781, Second Committee Engrossment, as amended (Obermueller) Labor and industry licensing provisions modified, and license fees modified and imposed.

Bill Marx, Chief Fiscal Analyst, responded to questions regarding HF2781, Second Committee Engrossment, as amended.

Rep. Kahn moved to amend HF2781, Second Committee Engrossment, as amended, as follows:

Page 16, line 24, after the period, insert:

"The commissioner must annually report to the committees of the legislature with responsibility for economic development and Minnesota Management and Budget on the use of appropriations under this section".

THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Thomas R. Joachim, Assistant Commissioner, Minnesota Department of Labor and Industry, responded to questions regarding HF2781, Second Committee Engrossment, as amended.

Rep. Rukavina renewed the motion that HF2781, Second Committee Engrossment, as amended, be recommended to pass and re-referred to the Committee on Ways and Means. THE MOTION PREVAILED.

Rep. Paymar moved that SF3116, First Engrossment be recommended to pass and placed on the General Register.

Rep. Bigham presented SF3116, First Engrossment (Bigham) DNA collection from offenders authorized.

Chair Carlson moved adoption of the Transportation Policy and Finance Division Report for HF3106, First Committee Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Chair Carlson moved that HF3106, First Committee Engrossment be recommended to pass and re-referred to the Committee on Ways and Means.

Chair Carlson moved to amend HF3106, First Committee Engrossment. (See attached amendment H3106A25). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Bigham presented HF3106, First Committee Engrossment, as amended (Bigham) Implied consent, driving while impaired, and ignition interlock provisions modified.

Rep. Kohls moved to amend HF3106, First Committee Engrossment, as amended. (See attached amendment A10-2479). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Chair Carlson renewed the motion that HF3106, First Committee Engrossment, as amended, be recommended to pass and re-referred to the Committee on Ways and Means. THE MOTION PREVAILED.

Vice-Chair Benson assumed chair at 10:20 A.M.

Vice-Chair Benson moved adoption of the Higher Education and Workforce Development Policy and Finance Division Report for HF3293, Second Committee Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Rep. Clark moved that SF3128, First Engrossment be recommended to pass and placed on the General Register.

Rep. Clark moved to delete the language from SF3128, First Engrossment and insert the language from HF3293, Second Committee Engrossment. THE MOTION PREVAILED.

Rep. Clark presented SF3128, First Engrossment, as amended (Clark) State building Code amended, and licensing requirements modified.

Sam Walseth, Sustainable Resource Center, responded to questions regarding SF3128, First Engrossment, as amended.

Rep. Clark renewed the motion that SF3128, First Engrossment, as amended, be recommended to pass and placed on the General Register. THE MOTION PREVAILED.

Vice-Chair Benson moved adoption of the Higher Education and Workforce Development Policy and Finance Division Report for HF2849, Second Committee Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Vice-Chair Benson moved that HF2849, Second Committee Engrossment be recommended to pass and re-referred to the Committee on Taxes.

Rep. Norton presented HF2849, Second Committee Engrossment (Norton) Minnesota and Wisconsin small business start-ups comparative study of state laws provided.

Vice-Chair Benson moved to amend HF2849, Second Committee Engrossment, as follows:

Page 1, after line 24, insert:
"(d) If a grant is not received for the comparative study, the legislative coordinating commission is not responsible for any of the tasks under this section"

Rep. Paymar moved adoption of the Public Safety Finance Division Report for HF2608, First Committee Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Rep. Paymar moved that SF2437, Second Engrossment be recommended to pass and placed on the General Register.

Rep. Paymar moved to amend SF2437, Second Engrossment. (See attached amendment S2437DE1). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Hilstrom presented SF2437, Second Engrossment, as amended (Hilstrom) Protection area extended to a reasonable area around residence or dwelling in ex parte orders for protection.

Rep. Paymar renewed the motion that SF2437, Second Engrossment, as amended, be recommended to pass and placed on the General Register. THE MOTION PREVAILED.

Rep. Paymar moved adoption of the Public Safety Finance Division Report for HF2990, First Committee Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Sue Dosal, State Court Administrator, Minnesota Judicial Branch, responded to questions regarding HF2990, First Engrossment, as amended.

Rep. Paymar amended the motion that HF2990, First Engrossment, as amended, be recommended to pass and re-referred to the Committee on Ways and Means. THE MOTION PREVAILED.

Rep. Paymar moved adoption of the Public Safety Finance Division Report for HF2965, Second Committee Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Rep. Paymar moved that HF2965, Second Committee Engrossment be recommended to pass and be placed on the General Register.

Rep. Paymar moved to amend HF2965, Second Committee Engrossment. (See attached amendment H2965A7). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Paymar presented HF2965, Second Committee Engrossment, as amended (Paymar) Gang and drug task forces certification process established, criminal gang investigative data systems creation authority established, certain entities dissolved, and forfeiture reporting requirements amended.

Michael Campion, Commissioner, Minnesota Department of Public Safety, responded to questions regarding HF2965, Second Committee Engrossment, as amended.

Rep. Paymar renewed the motion that HF2965, Second Committee Engrossment, as amended, be recommended to pass and be placed on the General Register. THE MOTION PREVAILED.

Rep. Champion moved adoption of the Transportation Policy and Finance Division Report for HF1005, First Committee Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Rep. Champion moved that HF1005, First Committee Engrossment be recommended to pass and re-referred to the Committee on Ways and Means.

Rep. Champion moved to amend HF1005, First Committee Engrossment. (See attached amendment H1005A2). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Reinert presented HF1005, First Committee Engrossment, as amended (Reinert) Enhanced driver's license and enhanced identification card created, application, issuance, and appearance of card provided, and Homeland Security secretary approval sought.

Rep. Champion renewed the motion that HF1005, First Committee Engrossment, as amended, be recommended to pass and re-referred to the Committee on Ways and Means. THE MOTION PREVAILED.

Rep. Slawik moved to amend SF2945, First Engrossment as amended, (amending the previously adopted Amendment S2945DE1), as follows:

Rep. Slawik withdrew the proposed oral amendment.

Rep. Buesgens moved to reconsider Rep. Paymar’s motion that previously adopted Amendment S2945DE1, amending SF2945, First Engrossment. THE MOTION PREVAILED.

Rep. Paymar withdrew Amendment S2945DE1.

Rep. Paymar withdrew the motion that SF2945, First Engrossment be recommended to pass and placed on the General Register.
