Representative Benson, Vice-Chair of the Finance Committee, called the meeting to order at 10:36 A.M. on Monday, April 20, 2009, in Room 200 of the State Office Building.

The Committee Legislative Assistant noted the roll.

Rep. Carlson moved approval of the minutes of Friday, April 17, 2009. THE MOTION PREVAILED. THE MINUTES WERE APPROVED.

Rep. Carlson moved that HF1221, First Committee Engrossment, be recommended to pass and re-referred to the Committee on Ways and Means.

Rep. Carlson moved to amend HF1221, First Committee Engrossment. (See attached amendment H1221DE1). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Bunn presented HF1221, First Committee Engrossment, as amended (Bunn) Stillwater lift bridge endowment account established.

Todd Clarkowski, Engineer, Minnesota Department of Transportation (Mn/DOT) responded to questions regarding HF1221, First Committee Engrossment, as amended.

Rep. Carlson renewed the motion that HF1221, First Committee Engrossment, as amended, be recommended to pass and re-referred to the Committee on Ways and Means. THE MOTION PREVAILED.

Rep. Kahn moved adoption of the State Government Finance Division Report for HF2251, First Committee Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Rep. Solberg moved that HF2251, First Committee Engrossment, be recommended to pass and re-referred to the Committee on Ways and Means.

Rep. Solberg moved to amend HF2251, First Committee Engrossment. (See attached amendment H2251A1). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Solberg presented HF2251, First Committee Engrossment, as amended, (Solberg) Federal stimulus oversight funding allocated for certain state agencies, money appropriated.



Rep. Solberg renewed the motion that HF2251, First Committee Engrossment, as amended, be recommended to pass and re-referred to the Committee on Ways and Means. THE MOTION PREVAILED.

Rep. Wagenius moved adoption of the Environment and Natural Resources Finance Division for HF0877, First Committee Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Rep. Wagenius moved that HF0877, First Committee Engrossment, be recommended to pass and be placed on the General Register.

Rep. Hortman presented HF0877, First Committee Engrossment (Hortman) Idling reduction technology purchases grant program established.

Rep. Wagenius renewed the motion that HF0877, First Committee Engrossment, be recommended to pass and be placed on the General Register. THE MOTION PREVAILED.

Rep. Wagenius moved adoption of the Environment and Natural Resources Finance Division Report for File 2175, First Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Rep. Wagenius moved that HF2175, First Engrossment, be recommended to pass and be placed on the General Register.

Rep. Hortman presented HF2175, First Engrossment (Hortman) Metro transit diesel bus idling reduction technology and hybrid bus grant program established.

Rep. Wagenius renewed the motion that HF2175, First Engrossment, be recommended to pass and be placed on the General Register. THE MOTION PREVAILED.

Rep. Carlson moved adoption of the Public Safety Finance Division Report for HF0267, First Committee Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Rep. Carlson moved that SF0099, First Engrossment be recommended to pass and re-referred to the Committee on Ways and Means.

Rep. Carlson moved to delete the language from SF0099 and insert the language from HF0267, First Committee Engrossment, as amended. THE MOTION PREVAILED.

Rep. Carlson moved to amend SF0099, First Engrossment, as amended by HF0267, First Committee Engrossment, as follows:

At line 1.24, before (C) add:
(C) For the purposes of this section, "child passenger restraint system" means any device that meets the standards of the United States Department of Transportation; is designed to restrain, seat, or position children; and includes a booster seat.

And renumber the sections accordingly.

THE MOTION PREVAILED. THE AMENDMNET WAS ADOPTED.

Rep. Hortman presented SF0099, First Engrossment, as amended (Hortman) Motor vehicle restraint required for child passengers under the age of eight and shorter than four feet nine inches and seat belt requirements modified accordingly.

Rep. Carlson renewed the motion that SF0099, First Engrossment, as amended, be recommended to pass and re-referred to the Committee on Ways and Means. THE MOTION PREVAILED.

Rep. Hilty moved that SF0656 be recommended to pass and be placed on the General Register.

Rep. Hilty presented SF0656 (Hilty) Appliance energy standards analysis by legislative energy commission.

Rep. Hilty renewed the motion that SF0656 be recommended to pass and be placed on the General Register.

A division was requested on the motion.

There were 15 Ayes and 5 Nays. THE MOTION PREVAILED.

Rep. Kahn moved adoption of the State Government Finance Division Report for HF2038, First Committee Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Rep. Solberg moved that HF2038, First Committee Engrossment be recommended to pass and re-referred to the Committee on Ways and Means.

Rep. Solberg presented HF2038, First Committee Engrossment (Solberg) Office of Strategic and Long-range Planning established, additional revenue priorities in general fund forecasts modified, report required, and money appropriated.

Rep. Solberg moved to amend HF2038, First Committee Engrossment. (See attached amendment A09-0389).

Rep. Solberg incorporated a technical amendment to Amendment A09-0389, as follows:

Page 1, line 2, delete "5" and insert "2" and delete "17" and insert "16"
Page 1, line 3, delete "9" and insert "2"
Page 1, line 4, delete "director of the Office of Geographic and Demographic Analysis" and insert "Department of Administration"

Bill Marx, Chief Fiscal Analyst responded to a question regarding the proposed amendment to HF2038, First Committee Engrossment.

Commissioner Dana B. Badgerow, Minnesota Department of Administration responded to questions regarding the proposed amendment to HF2038, First Committee Engrossment.

THE MOTION PREVAILED. THE AMENDMENT, AS AMENDED, WAS ADOPTED.

Vice-Chair Benson welcomed in the audience the 3rd grade class from Cedarcrest Academy, 6950 West Fish Lake Road, Maple Grove, Minnesota. Rep. Peppin recognized her daughter Mara Peppin who attends Cedarcrest Academy.

Rep. Solberg renewed the motion that HF2038, First Committee Engrossment, as amended, be recommended to pass and re-referred to the Committee on Ways and Means. THE MOTION PREVAILED.
