Representative Ann Lenczewski, Chair of the Committee, called the meeting to order at 10:11A.M. on Wednesday, April 11, 2007, in Room 10 of the State Office Building.

The Committee Legislative Assistant noted the roll.

HF1138 Masin Legal reference and data center facility construction materials and equipment sales tax exemption provided.

HF2129 Wardlow Eagan tax increment financing district authorized.

Rick King (Chief Operating Officer and Executive Vice President, Thomson-West), Harry Melander (Secretary-Treasurer, St. Paul Building and Trades Council) and Mayor Mike McGuire (City of Eagan) testified on HF1138 and HF2129.

A quorum was present at 10:22 A.M.

Representative Wollschlager assumed the gavel at 10:35 A.M.

Representative Lenczewski assumed the gavel at 10:38 A.M.

Representative Demmer moved HF2129 be laid over for possible inclusion in the Omnibus Tax Bill.

Representative Simpson moved HF1138 be laid over for possible inclusion in the Omnibus Tax Bill.

Representative Zellers moved approval of the minutes of March 29, 2007 and April 10, 2007. THE MOTION PREVAILED - THE MINUTES WERE APPROVED.

Dick Anfang (President, Minnesota State Building and Construction Trades Council) testified on HF1138 and HF2129.

HF1138 was laid over for possible inclusion in the Omnibus Tax Bill.

HF2129 was laid over for possible inclusion in the Omnibus Tax Bill.

The committee recessed at 11:41 A.M.

The committee reconvened at 12:18 P.M.

HF2237 Nelson Bloomington tax increment financing district improvements construction materials sales tax exemption provided, district duration extended and boundaries are modified, bonds issued, and money appropriated.

Representative Solberg moved HF2237 be laid over for possible inclusion in the Omnibus Tax Bill.

Mayor Gene Winstead (City of Bloomington), Dick Anfang (President, Minnesota State Building and Construction Trades Council), DaveYbarra (Minneapolis Building Trades Council), Bill Griffith (lobbyist for Mall of America), Clark Arneson (Assistant City Manager, City of Bloomington), Tony Armlin (Armlin & Associates) and Steven Buck (Bloomington resident) testified on HF2237.

Art Rolnick (Senior Vice President and Director of Research, Federal Reserve Bank of Minneapolis) gave an informational presentation on corporate subsidies.

HF2237 was laid over for possible inclusion in the Omnibus Tax Bill.

The committee recessed at 2:57 P.M.

SF2096 Anderson Environment, Natural Resources and Energy Omnibus Appropriations Bill

Representative Hilstrom moved SF2096, the Unofficial Engrossment, be recommended to pass and be re-referred to the Committee on Ways and Means.

Representative Jean Wagenius, Representative Rick Hansen and Representative Bill Hilty presented SF2096, the Unofficial Engrossment.

Jim Reinholdz (House Fiscal Analyst) and Ron Soderberg (House Fiscal Analyst) provided information on SF2096, the Unofficial Engrossment.

Representative Zellers moved the S2096A10 amendment to SF2096, the Unofficial Engrossment.

Representative Zellers requested a roll call vote on the S2096A10 amendment. The results were as follows:

Representative Simpson moved to amend SF2096, the Unofficial Engrossment, as follows:
Page 49, line 3, before "fees" insert "(a)"
Page 49, after line 10, insert:
"(b) The commissioner shall report to the legislature on the participation in and effectiveness of the venison donation program by February 1, 2010. The provisions of this subdivision and the imposition of the surcharge expires on June 30, 2010."

Representative Dill moved to amend the amendment as follows:
Remove β€œThe provisions of this subdivision and the imposition of the surcharge expires on June 30, 2010."

Representative Simpson incorporated Representative Dill's amendment. THE MOTION PREVAILED - THE AMENDMENT, AS AMENDED, WAS ADOPTED.

Representative Rukavina moved the A07-0725 amendment to SF2096, the Unofficial Engrossment.

Representative Rukavina withdrew the A07-0725 amendment to SF2096, the Unofficial Engrossment.

Representative Dill moved the A07-0729 amendment to SF2096, the Unofficial Engrossment.

Bob Tomlinson (Division of Forestry, Department of Natural Resources) testified on the A07-0729 amendment.

Representative Kohls moved the S2096A5 amendment to SF2096, the Unofficial Engrossment.

Jack Mansun (Department of Revenue) provided information on the H2227A26 amendment.

Representative Lenczewski renewed her motion of the H2227A26 amendment to HF2227, First Engrossment. THE MOTION PREVAILED - THE AMENDMENT WAS ADOPTED.

Representative Atkins renewed his motion that HF2227, as amended, be recommended to pass and be re-referred to the Committee on Ways and Means. THE MOTION PREVAILED - THE BILL PASSED AS AMENDED AND WAS RE-REFERRED TO THE COMMITTEE ON WAYS AND MEANS.

HF0829 Paymar Public Safety Finance Omnibus Bill.

Representative Solberg moved HF0829, First Engrossment, be recommended to pass and be re-referred to the Committee on Ways and Means.

Representative Simpson moved the H0829A39 amendment to HF0829, First Engrossment.

Representative Simpson moved to amend the H0829A39 amendment as follows:
Page 1, line 2, delete β€œ35" and insert β€œ34".

Representative Simpson withdrew the H0829A39 amendment.

Gary Karger (House Fiscal Analyst) provided information on HF0829, First Engrossment.

Representative Rukavina moved the H0829A36 amendment to HF0829, First Engrossment.

Mary Ellison (Deputy Commissioner, Department of Public Safety) testified on the H0829A36 amendment.

Representative Rukavina requested a division vote on the H0829A36 amendment. ON A VOTE OF 9 AYES AND 10 NAYS, THE MOTION DID NOT PREVAIL - THE AMENDMENT WAS NOT ADOPTED.

Representative Rukavina moved the A07-0726 amendment.

Representative Rukavina withdrew the A07-0726 amendment.

Representative Kohls moved the H0829A37 amendment.

Representative Kohls temporarily withdrew the H0829A37 amendment.

Representative Simpson moved the H0829A38 amendment.

Representative Paul Gardner testified on the H0829A38 amendment.

Representative Kohls requested a division vote on the H0829A38 amendment. ON A VOTE OF 10 AYES AND 14 NAYS, THE MOTION DID NOT PREVAIL - THE AMENDMENT WAS NOT ADOPTED.

Representative Kohls moved the H0829A37 amendment. THE MOTION PREVAILED - THE AMENDMENT WAS ADOPTED.

Mary Ellison (Deputy Commissioner, Department of Public Safety) answered a question regarding a previous amendment.

Representative Solberg renewed his motion that HF0829, First Engrossment, as amended, be recommended to pass and be re-referred to the Committee on Ways and Means. THE MOTION PREVAILED - THE BILL PASSED AS AMENDED AND WAS RE-REFERRED TO THE COMMITTEE ON WAYS AND MEANS.
