PUBLIC SAFETY AND CIVIL JUSTICE POLICY COMMITTEE MINUTES



Representative Mullery, Chair, called the meeting to order at 12:40 P.M. on Thursday, March 8, 2007, in Room 10 of the State Office Building.

The Committee Legislative Assistant noted the roll.

A quorum was present.

Representative DeLaForest moved approval of the Minutes for March 6, 2007. THE MOTION PREVAILED AND THE MINUTES WERE APPROVED.

HF 1178 (Lillie): A bill for an act relating to traffic regulations; requiring driver's license endorsement to operate three-wheeled motorcycle; amending Minnesota Statutes 2006, section 169.974, subdivision 2.

Representative Lillie presented HF 1178.

Testifying for the bill:
Pat McCormack, Director, Driver and Vehicle Services, Minnesota Department of Public Safety

Representative Lillie moved that HF 1178 be recommended to pass and re-referred to the Committee on Finance with a further recommendation that the bill be re-referred to the Transportation Finance Division. THE MOTION PREVAILED.

HF 738 (Greiling): A bill for an act relating to civil commitment; expanding early intervention services; amending Minnesota Statutes 2006, section 253B.065, subdivision 5.

Representative Paymar moved HF 738 before the committee.

Representative Greiling presented HF 738.

Representative Paymar moved that HF 738 be recommended to pass, and when so passed, be placed on the General Register. THE MOTION PREVAILED.

HF 611 (Anzelc): A bill for an act relating to labor; protecting certain communication in the workplace between labor organizations and employees; prohibiting certain employer conduct; providing civil remedies; proposing coding for new law in Minnesota Statutes, chapter 181.

Representative Bigham moved HF 611 before the committee.

Representative Mullery moved adoption of the A07-0203 amendment. THE AMENDMENT WAS ADOPTED.

Representative Mullery moved to orally amend HF 611 as follows:

Page 1, line 1.20, after "received" insert a comma

Page 1, line 1.21, strike the first "or" and after "responded" insert “, or forwarded"

THE ORAL AMENDMENT WAS INCORPORATED.

Representative Anzel presented the bill.

Representative Bigham moved that HF 611 be recommended to pass, as amended, and be re-referred to the Committee on Local Government and Metropolitan Affairs.

Chair Mullery ruled that the foregoing amendments were out of the jurisdiction of the committee. Discussion followed.

Representative Lesch moved to reconsider the incorporated amendments.

Representative Kohls requested a roll call vote. The clerk called the roll and the results were as follows:

Representative Holberg moved adoption of the H0611A3 amendment.

Chair Mullery ruled the amendment out of order. Representative Holberg challenged the ruling of the chair and requested a roll call vote. Chair Mullery clarified that an “Aye" vote would uphold the ruling of the Chair. The clerk called the roll and the results were as follows:

With a vote of 12 Ayes and 7 Nays, the ruling of the Chair was upheld.

Representative DeLaForest moved adoption of the H0611A4 amendment.

Representative Bigham renewed her motion that HF 611 be recommended to pass and be re-referred to the Committee on Local Government and Metropolitan Affairs.

After further discussion, Representative DeLaForest’s motion was ruled in order.

Chair Mullery laid HF 611 on the table.


The meeting was adjourned at 2:10 P.M.
