Representative Carlson, Chair of the Finance Committee, called the meeting to order at 9:19 A.M. on Monday, Monday, April 16, 2007, in Room 200 of the State Office Building.

The Committee Legislative Assistant noted the roll.

Rep. Paymar moved approval of the minutes of Thursday, April 12, 2007. THE MOTION PREVAILED. THE MINUTES WERE APPROVED.

Chair Carlson moved that HF931, First Engrossment, be recommended to pass and be placed
on the General Register.

Rep. Mullery presented HF931 First Engrossment (Mullery) (See language at http://wdoc.house.leg.state.mn.us/leg/LS85/HF0931.1.pdf). Predatory mortgage lending practices prohibited, and civil and criminal penalties imposed.

Chair Carlson move to amend HF931, First Engrossment. (See attached amendment A07-0715).

Chair Carlson incorporated the following amendment to Amendment A07-0715, as follows:

Page 2, line 5, after "counseling" insert "or credit counseling"
Page 2, line 32, after the period, insert "Provided the maximum term of imprisonment shall not exceed two years."

THE MOTI0N PREVAILED. THE AMENDMENT, AS AMENDED, WAS ADOPTED.

Chair Carlson moved that HF931, First Engrossment, as amended, be recommended to pass and be placed on the General Register. THE MOTION PREVAILED.

Chair Carlson moved adoption of the Higher Education and Workforce Development Division Report for SF238, First Committee Engrossment. (See language at http://wdoc.house.leg.state.mn.us/leg/LS85/CES0238.1.pdf). THE MOTION PREVAILED AND THE DIVISION REPORT WAS ADOTED.

Rep. Huntley presented SF238, First Committee Engrossment (Huntley) Freedom to Breathe Act
of 2007 adopted establishing public policy to protect employees and the public from hazards of
secondhand smoke and prohibiting persons from smoking in specified areas.

Rep. Huntley moved that SF238, First Committee Engrossment, be recommended to pass and be placed on the General Register.

Rep. Seifert moved to amend SF238, First Committee Engrossment. (See attached amendment S0238A5).

A division was requested on the motion.

There were 13 Ayes and 19 Nays. THE MOTION FAILED. THE AMENDMENT WAS NOT ADOPTED.

Rep. Rukavina moved to amend SF238, First Committee Engrossment. (See attached amendment A07-0771).

Rep. Rukavina withdrew the amendment.

Rep. Howes moved to amend SF238, First Committee Engrossment. (See attached amendment A07-0771).

Rep. Howes incorporated the following changes to amendment A07-0771.

Kathy Novak, House Research, clarified the amendment to Amendment A07-0771, as follows,

Page 1, delete Page 1, line 2 and insert “Page 6, line 26 to 30 and insert;"
Page 1, line 3 after “ rooms." insert “(A) "

Rep. Howes withdrew the amendment.

Rep. Huntley renewed the motion that SF238, First Committee Engrossment, be recommended to pass and be placed on the General Register.

Rep. Seifert requested a roll call on the motion.

Voting Aye: Carlson, Clark, Cornish, Erhardt, Greiling, Hausman, Hilty, Huntley, Jaros, Juhnke, Kahn, Lieder, Mahoney, Murphy, Paymar, Pelowski, Poppe, Sailer, Severson, Simon, Slawik, Thissen, Wagenius, Walker

Voting Nay: Anderson, B., Finstad, Garofalo, Hackbarth, Howes, Kohls, Otremba, Peppin, Rukavina, Seifert, Sertich, Solberg, Sviggum, Westrom

There were 24 Ayes and 14 Nays. THE MOTION PREVAILED.

Rep. Jaros move adoption of the Minnesota Heritage Finance Division Report for HF756. (See language at http://wdoc.house.leg.state.mn.us/leg/LS85/HF0756.0.pdf). THE MOTION PREVAILED AND THE DIVISON REPORT WAS ADOPTED.

Chair Carlson moved that SF585, First Unofficial Engrossment, be recommended to pass and be placed on the Consent Calendar.

Rep. Doty presented SF585/HF756 (Doty) National register of historic places property sale or
lease restrictions repeal.

Rep. Peppin moved to amend the Carlson motion that SF585, First Unofficial Engrossment, be recommended to pass and be placed on the General Register. THE MOTION PREVAILED.

Rep. Juhnke moved adoption of the Agriculture, Rural Economies and Veterans Affairs Finance Division Report for HF1901, First Committee Engrossment. (See language at http://wdoc.house.leg.state.mn.us/leg/LS85/CEH1901.1.pdf). THE MOTION PREVAILED AND THE DIVISION REPORT WAS ADOPTED.

Rep. Juhnke and Rep. Faust presented HF1901, First Committee Engrossment (Faust) World War II veterans memorial dedication activities funding provided, and money appropriated.

Rep. Juhnke moved that HF1901, First Committee Engrossment, be recommended to pass and be re-referred to the Committee on Ways and Means.

Rep. Juhnke moved to amend HF1901, First Committee Engrossment. (See attached amendment H1901A1 amendment).

Bill Marx, Chief Fiscal Analyst, responded to questions regarding the proposed Amendment H1901A1.

THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Juhnke renewed the motion that HF1901, First Committee Engrossment, as amended, be recommended to pass and be re-referred to the Committee on Ways and Means.
THE MOTION PREVAILED.
