Representative Jim Knoblach, Chair, called the forty-ninth meeting to order at 2:16 p.m. on
Wednesday, May 10, 2006 in Room 200 of the State Office Building.

The Clerk noted the roll.

Representative Knoblach called the meeting to order at 2:16 p.m. A quorum was present.

Representative Beard moved that the minutes of May 8, 2006 be approved.
THE MOTION PREVAILED.

HF3761 Holberg (first engrossment) Omnibus transportation finance bill establishing transit fund and accounts, providing motor vehicle tax allocation, modifying proposed constitutional amendment, issuing bonds, and appropriating money.

Representative Holberg moved that HF3761, first engrossment, be recommended to pass.

Representative Holberg, Bob McFarland, Assistant to the Commissioner, Minnesota Department of Transportation, and Norm Foster, Executive Budget Director, Minnesota Department of Finance testified on HF3761, first engrossment.

Representative Holberg moved the H3761A26 amendment.

Representative Holberg moved to orally amend the H3761A26 amendment by: P.1, L.1.2, change, “18” to “16” THE ORAL AMENDMENT WAS INCORPORATED.

HF3761, first engrossment, was laid over. (Committee had the incorrect version of the bill)

HF4183 Gunther Economic development and human services supplemental funding provided, and money appropriated.
Representative Gunther moved that HF4183 be recommended to pass.

Representative Gunther, Ron Soderberg, House Fiscal Analyst, Pat Nelson, Minnesota Department of Commerce, David Kelliher, Minnesota Historical Society, Jim Rhodes, Minnesota Department of Administration, Representative Hackbarth, Representative Sertich, and Ann Kaner-Roth, Executive Director, Child Care Workers testified on HF4183.

Representative Otremba moved the H4183A2 amendment. THE AMENDMENT WAS ADOPTED.

Representative Gunther moved the H4183A6 amendment. THE AMENDMENT WAS LAID OVER.

Representative Gunther moved the H4183A16 amendment. THE AMENDMENT WAS ADOPTED.

Representative Gunther moved the EL-BLKAMD28 amendment. THE AMENDMENT WAS ADOPTED.

Representative Erhardt moved the H4183A8 amendment. THE AMENDMENT WAS ADOPTED.

Representative Knoblach moved the H4183A11 amendment. THE AMENDMENT WAS ADOPTED.

Representative Gunther moved that the H4183A6 amendment be reconsidered. THE MOTION PREVAILED.

Representative Solberg moved to amend the H4183A6 amendment by:

P. 2, after line 25, insert, “Sec. 3 Twenty First Century Mineral Fund. $500,000 is transferred from the general fund in fiscal year 2008 only to the twenty first century mineral fund.”

P. 3, L. 33, after the period insert: in fiscal year 2008, to the extent the total fees collected by the commissioner in connection with these filings exceed $26,100,000 in a fiscal year, the commissioner shall refund, on a pro rata basis, to all persons who paid any fees for that fiscal year, the amount of fees for that fiscal year, the amount of fees collected by the commissioner in excess of $26,000,000.

P. 3, line 33, delete, “2008” and insert, “2009” THE HANDWRITTEN AMENDMENT WAS INCORPORATED.

Representative Seifert moved the H4183A14 amendment. THE AMENDMENT WAS ADOPTED.

Representative Seifert moved the HDA555 amendment. THE AMENDMENT WAS ADOPTED.

Representative Solberg moved the A06-1684 amendment.

Representative Solberg moved to orally amend the A06-1684 amendment by:

P.1, L1.1 change, “4018” to “4183” L., 1.2 change, “1’ to “16”, change, “4” to “23”, L.1.12 delete, “as follows” and insert, “accordingly” delete, “L.1.13” and L. “1.14”. THE ORAL AMENDMENT WAS INCORPORATED.

Representative Solberg moved that the A06-1684 amendment, as incorporated, be adopted.
THE AMENDMENT WAS ADOPTED.

Representative Gunther moved the H4183A10amendment. THE AMENDMENT WAS ADOPTED.

Representative Carlson moved the H4183A4 amendment. THE AMENDMENT WAS ADOPTED.

Representative Bradley moved the A06-1682 amendment. THE AMENDMENT WAS ADOPTED.

Representative Kelliher moved the H4183A17 amendment. THE AMENDMENT WAS NOT ADOPTED.

Representative Clark moved the H4183D19 amendment. THE AMENDMENT WAS ADOPTED.

Representative Clark withdrew the H4183D21 amendment.

Representative Clark moved the H4183D20 amendment. A division was called for and on a vote of 15 AYES and 13 NAYS THE AMENDMENT WAS ADOPTED.

Representative Clark moved the H4183D22 amendment. THE AMENDMENT WAS ADOPTED.

Representative Seifert moved to orally amend HF4183 by: P.21, L.21.3, delete, “section 3”

Representative Ozment moved the AO-1698 amendment. THE AMENDMENT WAS ADOPTED
