MINUTES


Representative Mark Olson, Chair of the Local Government Committee, called the fifteenth meeting to order at 12:34 P.M. on Monday, March 7, 2005, in Room 10 of the State Office Building.

The Clerk noted the roll.

A quorum was present.


GAROFALO, Pat moved the Minutes of March 2, 2005 be approved as prepared by the Clerk. THE MOTION PREVAILED


HF0547 (Charron) Washington County library board made advisory to the county board.

CHARRON, Mike moved that HF0547 be recommended to pass.

The following provided testimony on and responded to the Committee’s questions regarding HF0547:

Representative Mike Charron; and Myra Peterson (8284 Indian Blvd, Cottage Grove, MN, 55016), Chair, Washington County Board of Commissioners, 14949 62nd St N, PO Box 6, Stillwater, MN, 55082.

Without objection CHARRON, Mike withdrew his Motion.

LENCZEWSKI, Ann moved to recommended HF0547 be amended as follows:

Page 1, after line 20, insert:

"Sec. 2 [EFFECTIVE DATE.]

Section 1 is effective on the day after the governing body of Washington County complies with Minnesota Statues, section 645.021, subdivision 3."

At the request of the Chief Author and without objection the Lenczewski Motion to recommended HF0547 be amended Prevailed.

CHARRON, Mike moved to recommend that HF0547 be amended and when so amended be recommended to pass and be placed on the Consent Calendar. THE MOTION PREVAILED


HF0034 (Vandeveer) Washington County; Disabled Veterans Rest Camp on Big Marine Lake excluded from the Big Marine Park Reserve, and zoning districts provided.

OLSON, Mark moved HF0034 be recommended to pass and be re-referred to the Committee on Taxes.

OLSON, Mark moved to recommend HF0034 be amended as follows:

The Olson Motion to recommend HF0034 be amended Prevailed.

The following provided testimony on and responded to the Committee’s questions regarding HF0034 as amended:

Representative Ray Vandeveer; Jim Young (7188 Robinwood Trail, Woodbury, MN, 55125-2741), Member, Don Drigans (1637 Dayton Av, St. Paul Park, MN, 55071-1228), Treasurer and Member, and Harry Ostendorf (12801 Country View Lane, Burnsville, MN, 55337-3725), Vice-President and Member, all of the Board of Directors of the Disabled Veterans Rest Camp; and, Myra Peterson (see testimony on HF0547 above).

There being no further testimony pro or con, the question reoccurred on the Olson Motion that HF0034 be amended and when so amended be recommended to pass and be re-referred to the Committee on Taxes. THE MOTION PREVAILED


The Chair called Representative Lanning to the Chair.

HF1172 (Olson) Local government state mandate opt-out provided.

OLSON, Mark moved that HF1172 be recommended to pass and be re-referred to the Committee on Governmental Operations and Veterans Affairs Policy.

OLSON, Mark move to recommend HF1172 be amended as follows:

At the suggestion of House Research with the concurrence of the Author and without objection the following correction was incorporated into the Olson Amendment:

Page 1, line 2, strike "after" and insert "before"
Page 1, line 12, delete "38" and insert "50"
Page 1, line 13, delete "45" and insert "75"
Page 1, add a line 14 to read "Renumber the clauses in sequence"

The Olson Motion to recommend the amendment as corrected Prevailed.

OLSON, Mark moved to recommend that HF1172 be further amended as follows:

SAMUELSON, Char moved to recommend that HF1172 be further amended as follows:

Page 6, after line 24, insert:

"Subd. 7. [FIRE CODE.] A local government may not propose to opt out of fire code laws that are mandatory under chapter 299F."

The Samuelson Motion to recommend HF1172 be further amended Prevailed.

CORNISH, Tony moved to recommend that HF1172 be further amended as follows:

The Cornish Motion to recommend HF1172 be further amended Prevailed.

OLSON, Mark moved to recommend HF1172 be further amended as follows:

Page 6, lines 2, 5, 10, 17, and 21, after "not" insert "propose to"

The Olson Motion to recommend HF1172 be further amended Prevailed.

There being no further testimony pro or con, the question re-occurred on the Olson Motion to recommend that HF1172 be amended and when so amended be recommended to pass and be re-referred to the Committee on Governmental Operations and Veterans Affairs Policy. There being 11 ayes and 8 nays, THE MOTION PREVAILED.


The meeting was adjourned at 2:15 P.M.
