MINUTES


Representative Mark Olson, Chair of the Local Government Committee, called the forty-third meeting to order at 12:39 P.M. on Wednesday, March 29, 2006, in Room 10 of the State Office Building.

The clerk noted the roll.

HF3451 (Anderson, B) Land dedication standards provided.

OLSON, Mark moved HF3451 be recommended to pass.

The following provided testimony on and responded to the committee’s questions regarding HF3451:

Representative Bruce Anderson; and Peter Coyle (Suite 1500, 7900 Xerxes Av S, Bloomington, MN, 55431) on behalf of the Builders Association of Minnesota, Ste 150, 525 Park St, St Paul, MN, 55103.

ANDERSON, Bruce moved to recommend HF3451 be amended as follows:

The Anderson Motion Prevailed.

The following also provided testimony on and responded to the Committee’s questions regarding HF3451 as amended:

Tom Grundhoefer, General Counsel. League of Minnesota Cities, 145 University Av W, St. Paul, MN, 55103; Doug Carnival (Suite 2600, 800 Nicollet Mall, Minneapolis, MN, 55402) on behalf of the Minnesota Recreation and Parks Association, 200 Charles St NE, Fridley, MN, 55432; and Robert Lambert, Director, Parks and Recreation, City of Eden Prairie, 8080 Mitchell Rd, Eden Prairie, MN, 55344.

ANDERSON, Bruce moved to recommend HF3451 be further amended as follows:

On the H3451DE1 amendment, page 2, line 9 delete “must consider” and insert “shall give due consideration to” and after “facilities” insert “open to the public”

The Anderson Motion Prevailed.

At the request of the Chief Author and without objection HF3451 and the Olson Motion were laid on the table.


HF3095 (Hornstein) Minneapolis Park and Recreation Board and city council authorized to impose a park dedication fee on new housing units.

HORNSTEIN, Frank moved HF3095 be recommended to pass.

The following provided testimony on and responded to the Committee’s questions regarding HF3095:

Representative Frank Hornstein; Carol Kummer (4818 30th Av S, Minneapolis, MN, 55417), member, and Kirk Pederson (206 East Bridge – Riverplace, 10 2nd St NE, Minneapolis, MN, 55413), on behalf of, the Minneapolis Park and Recreation Board, 2117 West River Rd, Minneapolis, MN, 55411.

There being no further testimony, pro or con, the question reoccurred on the Hornstein Motion HF3095 be recommended to pass. THE MOTION PREVAILED.


HF3451 (Anderson, B) Land dedication standards provided. (continued)

Without objection, HF3451 and the Olson Motion as amended were again placed before the committee.

ANDERSON, Bruce moved to recommend HF3451 be further amended as follows:

On the H3451DE1 amendment, page 1, line 6 delete “developable” and insert “buildable” and after “land” insert “, as defined by municipal ordinance, ”

The Anderson Motion Prevailed.

ANDERSON, Bruce moved to recommend HF3451 be further amended as follows:

On the H3451DE1 amendment, page 2, line 2 delete “program” and insert “budget” and delete “adopt” and insert “have”

The Anderson Motion Prevailed.

ANDERSON, Bruce moved to recommend HF3451 be further amended as follows:

On the H3451DE1 amendment:
page 2, line 17 after “space” insert “based on the approved park systems plan”
page 2, line 18 delete the first comma and insert “or” and delete “, or redevelopment”

The Anderson Motion Prevailed.

ANDERSON, Bruce moved to recommend HF3451 be further amended as follows:

On the H3451DE1 amendment, page 2, line 20 after “based” insert “solely”

The Anderson Motion Prevailed.

There being no further testimony, pro or con, the question reoccurred on the Olson Motion as amended that HF3451 be amended and when so amended be recommended to pass. THE MOTION PREVAILED



MARQUART, Paul moved the Minutes of March 27, 2006 be approved as corrected. THE MOTION PREVAILED


Without objection the meeting was adjourned at 2:05 P.M.
