Representative Kathy Tingelstad, Chair of the Governmental Operations and Veterans Affairs Committee, called the twentieth meeting to order at 10:23 am on Thursday, March 03, 2005, in Room 5 of the State Office Building.

The Clerk noted the roll.

10:23:28 AM Representative Leon Lillie moved the approval of the minutes of Wednesday, March 2, 2005. THE MOTION PREVAILED.

HF1406 (Zellers) Criminal sexual conduct life without release sentences provided, maximum sentences increased, Sex Offender Review Board established, sentencing guidelines modified, and predatory offender registration and notification requirements modified.

10:24:30 AM Representative Tingelstad moved that HF1406 be recommended to pass and be re-referred to the Committee on Civil Law and Elections.

10:24:43 AM Representative Tingelstad moved the A05-0137 Amendment. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

10:25:35 AM The following witnesses testified regarding HF1406:

10:43:10 AM Representative Loeffler moved to amend HF1406 as follows:

Page 17, line 32 delete "January 15, 2006" and insert "December 15, 2005"

THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

10:55:06 AM Representative Tingelstad welcomed 9th grade visitors from Champlin Park High School, Champlin Park, MN, who were participants in the Capitol Historic Site’s “Voice of the People: Your Role in Minnesota Government” tour and educational program.

11:04:47 AM Representative Kahn moved to amend HF1406 as follows:

Page 108, line 8, delete everything after the period.
Page 108, delete line 9.

11:07:00 AM Representative Kahn withdrew her oral amendment.

11:07:20 AM Representative Kahn moved the H1406A2 Amendment.

11:08:00 AM Representative Tingelstad ruled the amendment was not germane to the committee’s jurisdiction and was not offered within the committee’s 24 hour rule.

11:12:00 AM Representative Kahn appealed the ruling of the Chair and asked for a roll call vote.

11:23:28 AM Representative Tingelstad renewed her motion that HF1406 be recommended to pass as amended and be re-referred to the Committee on Civil Law and Elections. THE MOTION PREVAILED AND THE BILL WAS PASSED.

HF826 (Ozment) relating to the environment; creating the Clean Water Legacy Act; providing authority, direction, and funding to achieve and maintain water quality standards for Minnesota's surface waters in accordance with section 303(d) of the federal Clean Water Act; appropriating money; proposing coding for new law in Minnesota Statutes chapter 446A; proposing coding for new law as Minnesota Statutes, chapter 114D.
