1.6    "Sec. .... Minnesota Statutes 2013 Supplement, section 245D.33, is amended to read:
1.7245D.33 ADULT MENTAL HEALTH CERTIFICATION STANDARDS.
1.8(a) The commissioner of human services shall issue a mental health certification
1.9for services licensed under this chapter when a license holder is determined to have met
1.10the requirements under section 245A.03, subdivision 6a, paragraph (b). This certification
1.11is voluntary for license holders. The certification shall be printed on the license and
1.12identified on the commissioner's public Web site.
1.13(b) The requirements for certification are:
1.14(1) all staff have received at least seven hours of annual training covering all of
1.15the following topics:
1.16(i) mental health diagnoses;
1.17(ii) mental health crisis response and de-escalation techniques;
1.18(iii) recovery from mental illness;
1.19(iv) treatment options, including evidence-based practices;
1.20(v) medications and their side effects;
1.21(vi) co-occurring substance abuse and health conditions; and
1.22(vii) community resources;
1.23(2) a mental health professional, as defined in section 245.462, subdivision 18, or a
1.24mental health practitioner as defined in section 245.462, subdivision 17, is available
1.25for consultation and assistance;
1.26(3) there is a plan and protocol in place to address a mental health crisis; and
2.1(4) each person's individual service and support plan identifies who is providing
2.2clinical services and their contact information, and includes an individual crisis prevention
2.3and management plan developed with the person.
2.4(c) License holders seeking certification under this section must request this
2.5certification on forms and in the manner prescribed by the commissioner.
2.6(d) (c) If the commissioner finds that the license holder has failed to comply with
2.7the certification requirements under section 245A.03, subdivision 6a, paragraph (b),
2.8the commissioner may issue a correction order and an order of conditional license in
2.9accordance with section 245A.06 or may issue a sanction in accordance with section
2.10245A.07 , including and up to removal of the certification.
2.11(e) (d) A denial of the certification or the removal of the certification based on a
2.12determination that the requirements under section 245A.03, subdivision 6a, paragraph
2.13(b) have not been met is not subject to appeal. A license holder that has been denied a
2.14certification or that has had a certification removed may again request certification when
2.15the license holder is in compliance with the requirements of section 245A.03, subdivision
2.166a, paragraph (b)."
2.17Renumber the sections in sequence and correct the internal references
2.18Amend the title accordingly
