1.3Page 43, after line 31, insert:

1.4    "Sec. .... Minnesota Statutes 2012, section 147B.01, subdivision 4, is amended to read:
1.5    Subd. 4. Acupuncture needle. "Acupuncture needle" means a needle designed
1.6exclusively for acupuncture purposes and regulated by the Food and Drug Administration
1.7as a medical device pursuant to the Code of Federal Regulations, title 21, section
1.88850.5580. It has a solid core, with a tapered point, and is 0.12 mm to 0.45 mm in
1.9thickness. It is constructed of stainless steel, gold, silver, or other board-approved
1.10materials as long as the materials can be sterilized according to recommendations of the
1.11National Centers for Disease Control and Prevention.

1.12    Sec. .... Minnesota Statutes 2012, section 147B.02, subdivision 1, is amended to read:
1.13    Subdivision 1. Licensure required. (a) Except as provided under subdivision 4,
1.14it is unlawful for any person to engage in the practice of acupuncture without a valid
1.15license after June 30, 1997. Each licensed acupuncture practitioner shall conspicuously
1.16display the license in the place of practice.
1.17(b) Except as provided under subdivision 4, it is unlawful for any person to use an
1.18acupuncture needle, as defined in section 147B.01, subdivision 4, to pierce the skin unless
1.19licensed as an acupuncture practitioner under this chapter."
1.20Renumber the sections in sequence and correct the internal references
1.21Amend the title accordingly
