1.3    "Sec. 4. Minnesota Statutes 2012, section 169.14, subdivision 5d, is amended to read:
1.4    Subd. 5d. Speed zoning limit in work zone; surcharge when workers present.
1.5(a) Notwithstanding subdivision 2 and subject to subdivision 3, the speed limit on a
1.6road having an established speed limit of 50 miles per hour or greater is adjusted to 45
1.7miles per hour in a work zone when (1) at least one lane or portion of a lane of traffic is
1.8closed in either direction, and (2) workers are present. A speed in excess of the adjusted
1.9speed limit is unlawful.
1.10(b) Paragraph (a) does not apply to a segment of road in which:
1.11(1) positive barriers are placed between workers and the traveled portion of the
1.12highway;
1.13(2) the work zone is in place for less than 24 hours;
1.14(3) a different speed limit for the work zone is determined by the road authority
1.15following an engineering and traffic investigation and based on accepted engineering
1.16practice; or
1.17(4) a different speed limit for the work zone is established by the road authority
1.18under paragraph (c).
1.19(c) The commissioner, on trunk highways and temporary trunk highways, and
1.20local authorities, on streets and highways under their jurisdiction, may authorize the use
1.21of reduced maximum speed limits in highway work zones when workers are present,
1.22without. The commissioner or local authority is not required to conduct an engineering
1.23and traffic investigation before authorizing a reduced speed limit in a highway work zone
1.24 required. The work zone speed limit must not reduce the speed limit on the affected
1.25street or highway by more than:
1.26(b) The minimum highway work zone speed limit is 20 miles per hour. The work
1.27zone speed limit must not reduce the established speed limit on the affected street or
2.1highway by more than 15 miles per hour, except that the highway work zone speed limit
2.2must not exceed 40 miles per hour. The commissioner or local authority shall post the limits
2.3of the work zone. Highway work zone speed limits are effective on erection of appropriate
2.4regulatory speed limit signs. The signs must be removed or covered when they are not
2.5required. A speed greater than the posted highway work zone speed limit is unlawful.
2.6(c) Notwithstanding paragraph (b), on divided highways the commissioner or local
2.7authority may establish a highway work zone speed limit that does not exceed 55 miles
2.8per hour.
2.9(d) Notwithstanding paragraph (b), on two-lane highways having one lane for
2.10each direction of travel with a posted speed limit of 60 miles per hour or greater, the
2.11commissioner or local authority may establish a highway work zone speed limit that
2.12does not exceed 40 miles per hour.
2.13(e) For purposes of this subdivision, "highway work zone" means a segment of
2.14highway or street where a road authority or its agent is constructing, reconstructing, or
2.15maintaining the physical structure of the roadway, its shoulders, or features adjacent to
2.16the roadway, including underground and overhead utilities and highway appurtenances,
2.17when workers are present.
2.18(f) Notwithstanding section 609.0331 or 609.101 or other law to the contrary, a person
2.19who violates a speed limit established under this subdivision, or who violates any other
2.20provision of this section while in a highway work zone, is assessed an additional surcharge
2.21equal to the amount of the fine imposed for the speed violation, but not less than $25.
2.22(1) 20 miles per hour, on a street or highway having an established speed limit of
2.2355 miles per hour or greater; and
2.24(2) 15 miles per hour, on a street or highway having an established speed limit of
2.2550 miles per hour or less.
2.26(d) A work zone speed limit under paragraph (c) is effective on erection of
2.27appropriate regulatory speed limit signs. The signs must be removed or covered when
2.28they are not required. A speed in excess of the posted work zone speed limit is unlawful.
2.29(e) For any speed limit under this subdivision, a road authority shall erect signs
2.30identifying the speed limit and indicating the beginning and end of the speed limit zone.
2.31EFFECTIVE DATE.This section is effective August 1, 2014, and applies to
2.32violations committed on or after that date."
