1.3    "Sec. 7. Minnesota Statutes 2012, section 383D.41, is amended by adding a subdivision
1.4to read:
1.5    Subd. 10. Housing improvement areas. (a) The Dakota County Community
1.6Development Agency has all powers of a city, in addition to its existing powers as an
1.7implementing entity, under sections 428A.11 to 428A.21, in connection with housing
1.8improvement areas in Dakota County. For purposes of the Dakota County Community
1.9Development Agency's exercise of those powers the provisions of this subdivision apply.
1.10(b) References in sections 428A.11 through 428A.21 to:
1.11(1) a "mayor" are references to the executive director of the Dakota County
1.12Community Development Agency;
1.13(2) a "council" are references to the board of commissioners of the Dakota County
1.14Community Development Agency; and
1.15(3) a "city clerk" are references to an official of the Dakota County Community
1.16Development Agency designated from time to time by the executive director of the Dakota
1.17County Community Development Agency.
1.18(c) Notwithstanding section 428A.11, subdivision 3, and 428A.13, subdivision 1,
1.19the governing body of the Dakota County Community Development Agency may adopt
1.20a resolution, rather than an ordinance, establishing one or more housing improvement
1.21areas, and "enabling ordinance" means a resolution so adopted for purposes of sections
1.22428A.11 to 428A.21.
1.23(d) As long as the governing body of the Dakota County Community Development
1.24Agency and the Dakota County Board of Commissioners consists of identical membership,
1.25the Dakota County Community Development Agency may pledge the full faith, credit and
1.26taxing power of Dakota County to obligations issued by the Dakota County Community
1.27Development Agency under section 428A.16.
2.1(e) Notwithstanding the provisions of section 428A.21, the establishment by the
2.2Dakota County Community Development Agency of a new housing improvement area
2.3after June 30, 2016, requires enactment of a special law authorizing establishment of the
2.4area. Any extensions of the deadline for housing improvement districts under general law
2.5beyond that date or repeal of the deadline also applies to housing improvement areas
2.6established by the Dakota County Community Development Agency."
2.7Renumber the sections in sequence and correct the internal references
2.8Amend the title accordingly
