1.4    "Sec. 9. Minnesota Statutes 2012, section 256B.431, subdivision 44, is amended to read:
1.5    Subd. 44. Property rate increase increases for a facility in Bloomington effective
1.6November 1, 2010 certain nursing facilities. (a) Notwithstanding any other law to the
1.7contrary, money available for moratorium projects under section 144A.073, subdivision
1.811 , shall be used, effective November 1, 2010, to fund an approved moratorium exception
1.9project for a nursing facility in Bloomington licensed for 137 beds as of November 1,
1.102010, up to a total property rate adjustment of $19.33.
1.11(b) Effective June 1, 2012, any nursing facility in McLeod County licensed for 110
1.12beds shall have its replacement-cost-new limit under subdivision 17e adjusted to allow
1.13$1,129,463 of a completed construction project to increase the property payment rate.
1.14Notwithstanding any other law to the contrary, money available under section 144A.073,
1.15subdivision 11, after the completion of the moratorium exception approval process in 2013
1.16under section 144A.073, subdivision 3, shall be used to reduce the fiscal impact to the
1.17medical assistance budget for the increase in the replacement-cost-new limit.
1.18EFFECTIVE DATE.This section is effective retroactively from June 1, 2012."
