1.4    "Section 1. DIRECTION TO COMMISSIONERS; INCOME AND ASSET
1.5EXCLUSION.
1.6(a) The commissioner of human services shall not count conditional cash transfers
1.7made to families participating in a family independence demonstration as income or
1.8assets for purposes of determining or redetermining eligibility for child care assistance
1.9programs under Minnesota Statutes, chapter 119B; general assistance under Minnesota
1.10Statutes, chapter 256D; group residential housing under Minnesota Statutes, chapter 256I;
1.11the Minnesota family investment program, work benefit program, or diversionary work
1.12program under Minnesota Statutes, chapter 256J; or the MinnesotaCare program under
1.13Minnesota Statutes, chapter 256L, during the duration of the demonstration.
1.14(b) The commissioner of human services shall not count conditional cash transfers
1.15made to families participating in a family independence demonstration as income or assets
1.16for purposes of determining or redetermining eligibility for medical assistance, except
1.17that for enrollees subject to a modified adjusted gross income calculation to determine
1.18eligibility, the conditional cash transfer payments shall be counted as income if they are
1.19included on the enrollee's federal tax return as income or if the payments can be taken into
1.20account in the month of receipt as a lump sum payment.
1.21(c) The commissioner of the Minnesota Housing Finance Agency shall not count
1.22conditional cash transfers made to families participating in a family independence
1.23demonstration as income or assets for purposes of determining or redetermining eligibility
1.24for housing assistance programs under Minnesota Statutes, section 462A.201, during the
1.25duration of the demonstration. For purposes of this section:
2.1(1) "conditional cash transfer" means a payment made to a participant in a family
2.2independence demonstration by a sponsoring organization to incent, support, or facilitate
2.3participation; and
2.4(2) "family independence demonstration" means an initiative sponsored or
2.5co-sponsored by a governmental or nongovernmental organization, the goal of which is
2.6to facilitate individualized goal setting and peer support for cohorts of no more than 12
2.7families each toward the development of financial and nonfinancial assets that enable the
2.8participating families to achieve financial independence."
