1.2Delete everything after the enacting clause and insert:

1.3    "Section 1. STUDY OF TICKETING PRACTICES.
1.4(a) The commissioner of commerce shall study and analyze the manner in which
1.5event tickets are sold in Minnesota, and the ways in which consumers are impacted by
1.6ticket selling practices. The commissioner shall also study and analyze the economic
1.7impact of the sports and entertainment industry in Minnesota and the potential change in
1.8economic impact which may occur if proposed regulation of ticket sales presently pending
1.9before the legislature were to be enacted into law.
1.10(b) The commissioner shall report to the legislature by January 15, 2014. The report
1.11must include the following items:
1.12(1) an overview of current practices regarding ticket sales in the primary and
1.13secondary markets;
1.14(2) an overview of the current sports and entertainment industry including total
1.15employment and taxes paid;
1.16(3) an analysis of consumer complaints regarding ticket sales in the primary and
1.17secondary markets;
1.18(4) an analysis of existing laws regulating ticket sales, including the effectiveness of
1.19enforcement activity and recommendations to improve enforcement;
1.20(5) if deceptive practices are identified, recommendations for prohibiting deceptive
1.21practices in the sale of tickets to protect consumers and ensure the economic vitality of the
1.22sports and entertainment industry in Minnesota;
1.23(6) an analysis of where tickets are distributed in the primary market and how many
1.24tickets are available to the general public;
1.25(7) an analysis of where tickets sold in the secondary market are obtained;
1.26(8) an analysis of computerized bot software use; and
2.1(9) any other information, analysis, or recommendations the commissioner believes
2.2will be useful to the legislature.

2.3    Sec. 2. APPROPRIATION.
2.4$....... is appropriated from the general fund in fiscal year 2014 to the commissioner
2.5of commerce for the study of ticketing practices in section 1. This is a onetime
2.6appropriation and is available until June 30, 2015."
