1.3    "Section 1. Minnesota Statutes 2012, section 124D.128, subdivision 2, is amended to
1.4read:
1.5    Subd. 2. Commissioner designation. (a) A state-approved alternative program and
1.6a state-approved recovery program designated by the state must be a site. A state-approved
1.7alternative program must provide services to students who meet the criteria in section
1.8124D.68 and who are enrolled in:
1.9    (1) a district that is served by the state-approved alternative program; or
1.10    (2) a charter school located within the geographic boundaries of a district that is
1.11served by the state-approved alternative program.
1.12    (b) A school district or charter school may be approved biennially by the state to
1.13provide additional instructional programming that results in grade level acceleration. The
1.14program must be designed so that students make grade progress during the school year
1.15and graduate prior to the students' peers.
1.16    (c) To be designated, a district, charter school, or state-approved alternative program
1.17must demonstrate to the commissioner that it will:
1.18    (1) provide a program of instruction that permits pupils to receive instruction
1.19throughout the entire year; and
1.20    (2) develop and maintain a separate record system that, for purposes of section
1.21126C.05 , permits identification of membership attributable to pupils participating in the
1.22program. The record system and identification must ensure that the program will not have
1.23the effect of increasing the total average daily membership attributable to an individual
1.24pupil as a result of a learning year program. The record system must include the date the
1.25pupil originally enrolled in a learning year program, the pupil's grade level, the date of
1.26each grade promotion, the average daily membership generated in each grade level, the
1.27number of credits or standards earned, and the number needed to graduate.
2.1    (d) A student who has not completed a school district's graduation requirements
2.2may continue to enroll in courses the student must complete in order to graduate until
2.3the student satisfies the district's graduation requirements or the student is 21 years old,
2.4whichever comes first.
2.5EFFECTIVE DATE.This section is effective July 1, 2014."
