1.3    "Sec. 2. Minnesota Statutes 2010, section 473.388, subdivision 4, is amended to read:
1.4    Subd. 4. Financial assistance. (a) The council must grant the requested financial
1.5assistance if it determines that the proposed service is intended to replace the service to
1.6the applying city or town or combination thereof by the council and that the proposed
1.7service will meet the needs of the applicant at least as efficiently and effectively as the
1.8existing service.
1.9    (b) The minimum amount of assistance which the council must provide to a system
1.10under this section may not be less than the sum of the amounts calculated or determined
1.11for each municipality comprising the system as follows: of the replacement service
1.12municipalities as provided in paragraphs (c) and (d).
1.13(c) For each replacement service municipality that received assistance under this
1.14section in 2011, the minimum amount of financial assistance is calculated as:
1.15    (1) the transit operating assistance grants received under this subdivision by the
1.16municipality in calendar year 2001 or the tax revenues for transit services levied by the
1.17municipality for taxes payable in 2001, including that portion of the levy derived from
1.18the areawide pool under section 473F.08, subdivision 3, clause (a), plus the portion of
1.19the municipality's aid under section 273.1398, subdivision 2, attributable to the transit
1.20levy; times
1.21    (2) the ratio of (i) an amount equal to 3.74 percent of the state revenues generated
1.22from the taxes imposed under chapter 297B for the current fiscal year to (ii) the total
1.23transit operating assistance grants received under this subdivision in calendar year 2001 or
1.24the tax revenues for transit services levied by all replacement service municipalities under
1.25this section for taxes payable in 2001, including that portion of the levy derived from
1.26the areawide pool under section 473F.08, subdivision 3, clause (a), plus the portion of
2.1homestead and agricultural credit aid under section 273.1398, subdivision 2, attributable
2.2to nondebt transit levies, times
2.3    (3) the ratio of (i) the municipality's total taxable market value for taxes payable
2.4in 2006 divided by the municipality's total taxable market value for taxes payable in
2.52001, to (ii) the total taxable market value of all property located in replacement service
2.6municipalities for taxes payable in 2006 divided by the total taxable market value of all
2.7property located in replacement service municipalities for taxes payable in 2001.
2.8(d) For each replacement service municipality that first begins receiving assistance
2.9under this section after January 1, 2012, the council shall identify a minimum amount of
2.10assistance. The amount must be (1) to the extent practical, commensurate with the amount
2.11of assistance provided under paragraph (c); and (2) based on criteria developed by the
2.12council, including the following factors: operating expenses and revenues from other
2.13sources, service hours, ridership, and service performance standards.
2.14    (c) (e) The council shall pay the amount to be provided to the recipient from the
2.15funds the council receives in the metropolitan area transit account under section 16A.88."
