1.4    "Sec. .... Minnesota Statutes 2011 Supplement, section 256B.5012, subdivision 13,
1.5is amended to read:
1.6    Subd. 13. ICF/DD rate decrease effective July 1, 2012 2013. Notwithstanding
1.7subdivision 12, for each facility reimbursed under this section, the commissioner shall
1.8decrease operating payments equal to 1.67 percent of the operating payment rates in effect
1.9on June 30, 2012 2013. For each facility, the commissioner shall apply the rate reduction
1.10based on occupied beds, using the percentage specified in this subdivision multiplied by
1.11the total payment rate, including the variable rate but excluding the property-related
1.12payment rate, in effect on the preceding date. The total rate reduction shall include the
1.13adjustment provided in section 256B.501, subdivision 12.

1.14    Sec. .... Laws 2011, First Special Session chapter 9, article 7, section 54, is amended to
1.15read:
1.16    Sec. 54. CONTINGENCY PROVIDER RATE AND GRANT REDUCTIONS.
1.17(a) Notwithstanding any other rate reduction in this article, the commissioner of
1.18human services shall decrease grants, allocations, reimbursement rates, individual limits,
1.19and rate limits, as applicable, by 1.67 percent effective July 1, 2012 2013, for services
1.20rendered on or after those dates. County or tribal contracts for services specified in this
1.21section must be amended to pass through these rate reductions within 60 days of the
1.22effective date of the decrease, and must be retroactive from the effective date of the rate
1.23decrease.
1.24(b) The rate changes described in this section must be provided to:
2.1(1) home and community-based waivered services for persons with developmental
2.2disabilities or related conditions, including consumer-directed community supports, under
2.3Minnesota Statutes, section 256B.501;
2.4(2) home and community-based waivered services for the elderly, including
2.5consumer-directed community supports, under Minnesota Statutes, section 256B.0915;
2.6(3) waivered services under community alternatives for disabled individuals,
2.7including consumer-directed community supports, under Minnesota Statutes, section
2.8256B.49 ;
2.9(4) community alternative care waivered services, including consumer-directed
2.10community supports, under Minnesota Statutes, section 256B.49;
2.11(5) traumatic brain injury waivered services, including consumer-directed
2.12community supports, under Minnesota Statutes, section 256B.49;
2.13(6) nursing services and home health services under Minnesota Statutes, section
2.14256B.0625, subdivision 6a ;
2.15(7) personal care services and qualified professional supervision of personal care
2.16services under Minnesota Statutes, section 256B.0625, subdivisions 6a and 19a;
2.17(8) private duty nursing services under Minnesota Statutes, section 256B.0625,
2.18subdivision 7
;
2.19(9) day training and habilitation services for adults with developmental disabilities
2.20or related conditions, under Minnesota Statutes, sections 252.40 to 252.46, including the
2.21additional cost of rate adjustments on day training and habilitation services, provided as a
2.22social service under Minnesota Statutes, section 256M.60; and
2.23(10) alternative care services under Minnesota Statutes, section 256B.0913.
2.24(c) A managed care plan receiving state payments for the services in this section
2.25must include these decreases in their payments to providers. To implement the rate
2.26reductions in this section, capitation rates paid by the commissioner to managed care
2.27organizations under Minnesota Statutes, section 256B.69, shall reflect a 2.34 percent
2.28reduction for the specified services for the period of January 1, 2013, through June 30,
2.292013, and a 1.67 percent reduction for those services on and after July 1, 2013.
2.30The above payment rate reduction, allocation rates, and rate limits shall expire for
2.31services rendered on December 31, 2013."
