1.3Page 44, after line 4, insert:

1.4    "Sec. .... Minnesota Statutes 2010, section 256B.431, subdivision 17e, is amended to
1.5read:
1.6    Subd. 17e. Replacement-costs-new per bed limit effective October 1, 2007.
1.7    Notwithstanding Minnesota Rules, part 9549.0060, subpart 11, item C, subitem (2),
1.8for a total replacement, as defined in subdivision 17d, authorized under section
1.9144A.071 or 144A.073 after July 1, 1999, any building project that is a relocation,
1.10renovation, upgrading, or conversion completed on or after July 1, 2001, or any
1.11building project eligible for reimbursement under section 256B.434, subdivision 4f, the
1.12replacement-costs-new per bed limit shall be $74,280 per licensed bed in multiple-bed
1.13rooms, $92,850 per licensed bed in semiprivate rooms with a fixed partition separating
1.14the resident beds, and $111,420 per licensed bed in single rooms. Minnesota Rules, part
1.159549.0060, subpart 11, item C, subitem (2), does not apply. These amounts must be
1.16adjusted annually as specified in subdivision 3f, paragraph (a), beginning January 1,
1.172000. These amounts must be increased annually as specified in subdivision 3f, paragraph
1.18(a), beginning October 1, 2012.

1.19    Sec. .... Minnesota Statutes 2010, section 256B.431, is amended by adding a
1.20subdivision to read:
1.21    Subd. 45. Rate adjustments for some moratorium exception projects.
1.22Notwithstanding any other law to the contrary, money available for moratorium exception
1.23projects under section 144A.073, subdivisions 2 and 11, shall be used to fund the
1.24incremental rate increases resulting from this section for any nursing facility with a
1.25moratorium exception project approved under section 144A.073, and completed after
1.26August 30, 2010, where the replacement-costs-new limits under subdivision 17e were
2.1higher at any time after project approval than at the time of project completion. The
2.2commissioner shall calculate the property rate increase for these facilities using the highest
2.3set of limits; however, any rate increase under this section shall not be effective until on
2.4or after the effective date of this section, contingent upon federal approval. No property
2.5rate decrease shall result from this section.
2.6EFFECTIVE DATE.This section is effective upon federal approval."
