1.2Delete everything after the enacting clause and insert:

1.3    "Section 1. FOSTER CARE FOR INDIVIDUALS WITH AUTISM.
1.4The commissioner of human services shall identify and coordinate with one or more
1.5counties that agree to issue a license and authorize funding for licensed foster care for
1.6people with autism (1) who are currently receiving home and community-based services
1.7under Minnesota Statutes, section 256B.092 or 256B.49; (2) who are in out-of-home
1.8placement approved by the lead agency; (3) who are in need of continuous supervision; and
1.9(4) whose needs cannot be met in their current residential setting or in any other existing
1.10residential setting. Nothing in this section must be construed as restricting an individual's
1.11choice of provider. The commissioner will assist the interested county or counties with
1.12obtaining necessary capacity within the moratorium under Minnesota Statutes, section
1.13245A.03, subdivision 7. The commissioner shall coordinate with the interested counties
1.14and issue a request for information to identify providers who have the training and skills
1.15to meet the needs of the individuals identified in this section. The commissioner shall
1.16provide advice to providers that respond to the request for information, and who request or
1.17who the commissioner determines need additional skills development resources.

1.18    Sec. 2. DIRECTION TO COMMISSIONER.
1.19The commissioner shall develop an optional certification for providers of home
1.20and community-based services waivers under Minnesota Statutes, sections 256B.092
1.21or 256B.49, that demonstrates competency in working with individuals with autism.
1.22Recommended language and an implementation plan will be provided to the chairs and
1.23ranking minority members of the legislative committees with jurisdiction over health and
1.24human services policy and finance by February 15, 2013, as part of the Quality Outcome
1.25Standards required under Laws 2010, chapter 352, article 1, section 24."
1.26Amend the title accordingly
