1.3    "Sec. 5. Minnesota Statutes 2010, section 373.01, subdivision 3, is amended to read:
1.4    Subd. 3. Capital notes. (a) A county board may, by resolution and without
1.5referendum, issue capital notes subject to the county debt limit to purchase capital
1.6equipment useful for county purposes that has an expected useful life at least equal to the
1.7term of the notes. The notes shall be payable in not more than ten years and shall be
1.8issued on terms and in a manner the board determines. A tax levy shall be made for
1.9payment of the principal and interest on the notes, in accordance with section 475.61,
1.10as in the case of bonds.
1.11    (b) For purposes of this subdivision, "capital equipment" means:
1.12    (1) public safety, ambulance, road construction or maintenance, and medical
1.13equipment; and
1.14    (2) computer hardware and software, whether bundled with machinery or equipment
1.15or unbundled, together with application development services and training related to the
1.16use of the computer hardware and software and fiber-optic cable or other means of voice
1.17and data transmission among municipal buildings, provided that software, application,
1.18and development services and training are deemed to have the same useful life as the
1.19computer equipment to which they are related."
