1.3Page 6, after line 18, insert:

1.4    "Sec. 12. Minnesota Statutes 2010, section 84D.08, is amended to read:
1.584D.08 ESCAPE OF NONNATIVE AND INVASIVE SPECIES.
1.6(a) A person that allows or causes the introduction of an animal that is a prohibited
1.7invasive, regulated invasive, or unlisted nonnative species shall, within 24 hours after
1.8learning of the introduction, notify the commissioner, a conservation officer, or another
1.9person designated by the commissioner. The person shall make every reasonable attempt
1.10to recapture or destroy the introduced animal. If the animal is a prohibited invasive
1.11species, the person is liable for the actual costs incurred by the department in capturing or
1.12controlling, or attempting to capture or control, the animal and its progeny. If the animal is
1.13a regulated invasive species, the person is liable for these costs if the introduction was in
1.14violation of the person's permit issued under section 84D.11.
1.15(b) A person may not deliberately release swine from captivity and allow the swine
1.16to be introduced into the wild.
1.17(c) A person that complies with this section is not subject to criminal penalties
1.18under section 84D.13 for the introduction."
1.19Page 6, after line 29, insert:

1.20    "Sec. 14. Minnesota Statutes 2010, section 84D.14, is amended to read:
1.2184D.14 EXEMPTIONS.
1.22    This chapter does not apply to:
1.23    (1) pathogens and terrestrial arthropods regulated under sections 18G.01 to 18G.15;
1.24or
1.25    (2) mammals and birds defined by statute as livestock, except for swine as provided
1.26under section 84D.08, paragraph (b)."
