1.3    "Sec. 2. [617.248] CREATION AND DISSEMINATION OF INDECENT
1.4MATERIAL INVOLVING JUVENILES.
1.5    Subdivision 1. Offense. (a) A person 17 years of age or younger shall not knowingly
1.6and voluntarily, without threat or coercion, use a computer or electronic device to transmit
1.7a visual depiction of sexual conduct involving the minor to another person.
1.8(b) A juvenile 13 years of age or older shall not knowingly and voluntarily, without
1.9threat or coercion, allow a person to take a photo of the minor that depicts sexual conduct.
1.10(c) A juvenile 13 years of age or older shall not knowingly take a photo of a juvenile
1.1113 years of age or older that depicts sexual conduct.
1.12(d) No person shall knowingly possess a visual depiction transmitted to the person
1.13in violation of paragraph (a). It shall not be a violation of this section if the person took
1.14reasonable steps, whether successful or not, to destroy or eliminate the visual depiction.
1.15    Subd. 2. Penalties. (a) A person who violates subdivision 1, paragraph (a), (b), or
1.16(c), is guilty of a misdemeanor.
1.17(b) A person who violates subdivision 1, paragraph (d), is guilty of a gross
1.18misdemeanor.
1.19    Subd. 3. Bar to prosecution and registration. A person 17 years of age or younger
1.20who violates this section and has not previously violated this section shall not be charged
1.21under any other section of law and shall not be required to register as a predatory offender
1.22based solely on a violation of this section.
1.23    Subd. 4. Definition. For purposes of this section, "sexual conduct" has the meaning
1.24provided in section 617.245, subdivision 1, paragraph (e).
1.25EFFECTIVE DATE.This section is effective August 1, 2010, and applies to crimes
1.26committed on or after that date."
