1.3Page 4, after line 13, insert:

1.4    "Sec. 6. Minnesota Statutes 2009 Supplement, section 84.415, subdivision 6, is
1.5amended to read:
1.6    Subd. 6. Supplemental application fee and monitoring fee. (a) In addition to the
1.7application fee and utility crossing fees specified in Minnesota Rules, the commissioner of
1.8natural resources shall assess the applicant for a utility license the following fees:
1.9(1) a supplemental application fee of $1,500 $2,000 for a public water crossing
1.10license and a supplemental application fee of $4,500 $2,000 for a public lands crossing
1.11license, to cover reasonable costs for reviewing the application and preparing the license;
1.12and
1.13(2) a monitoring fee to cover the projected reasonable costs for monitoring the
1.14construction of the utility line and preparing special terms and conditions of the license
1.15to ensure proper construction. The commissioner must give the applicant an estimate of
1.16the monitoring fee before the applicant submits the fee.
1.17(b) The applicant shall pay fees under this subdivision to the commissioner of
1.18natural resources. The commissioner shall not issue the license until the applicant has
1.19paid all fees in full.
1.20(c) Upon completion of construction of the improvement for which the license
1.21or permit was issued, the commissioner shall refund the unobligated balance from the
1.22monitoring fee revenue. The commissioner shall not return the application fees, even
1.23if the application is withdrawn or denied.
1.24(d) If the fees collected under paragraph (a), clause (1), are not sufficient to cover
1.25the costs of reviewing the applications and preparing the licenses, the commissioner shall
1.26improve efficiencies and otherwise reduce department costs and activities to ensure the
2.1revenues raised under paragraph (a), clause (1), are sufficient, and that no other funds are
2.2necessary to carry out the requirements."
