1.3Page 3, after line 17, insert:

1.4    "Sec. 3. Minnesota Statutes 2009 Supplement, section 136A.01, subdivision 2, is
1.5amended to read:
1.6    Subd. 2. Responsibilities. (a) The Minnesota Office of Higher Education is
1.7responsible for:
1.8(1) necessary state level administration of financial aid programs, including
1.9accounting, auditing, and disbursing state and federal financial aid funds, and reporting on
1.10financial aid programs to the governor and the legislature;
1.11(2) approval, registration, licensing, and financial aid eligibility of private collegiate
1.12and career schools, under sections 136A.61 to 136A.71 and chapter 141;
1.13(3) negotiating and administering reciprocity agreements;
1.14(4) publishing and distributing financial aid information and materials, and other
1.15information and materials under section 136A.87, to students and parents;
1.16(5) collecting and maintaining student enrollment and financial aid data and
1.17reporting data on students and postsecondary institutions to develop and implement a
1.18process to measure and report on the effectiveness of postsecondary institutions;
1.19(6) administering the federal programs that affect students and institutions on a
1.20statewide basis; and
1.21(7) prescribing policies, procedures, and rules under chapter 14 necessary to
1.22administer the programs under its supervision.
1.23(b) The office is authorized to match individual student data from the student record
1.24enrollment database with individual student financial aid data collected and maintained
1.25by the office in order to audit or evaluate federal or state supported education programs
1.26as permitted by United States Code, title 20, section 1232g(b)(3), and Code of Federal
1.27Regulations, title 34, section 99.35. The office may match data from the following
2.1financial aid program databases with data from the student record enrollment database:
2.2tuition reciprocity; the state grant; the SELF loan; state work study; the postsecondary
2.3child care grant; the American Indian Scholarship; and the Achieve Scholarship. The
2.4office shall conduct the study in a manner that does not permit personal identification of
2.5parents or students by individuals other than representatives of the office."
2.6Renumber the sections in sequence and correct the internal references
2.7Amend the title accordingly
