Page 3, delete section 1 and insert:
"Section 1. [62Q.545] COVERAGE OF PRIVATE DUTY NURSING SERVICES.
1.4(a) A health plan must cover private duty nursing services for persons who are
1.5covered under the health plan, are on medical assistance, and require private duty nursing
1.6services as defined in section 256B.0625, subdivision 7.
1.7(b) For purposes of this section, a period of private duty nursing services may
1.8be subject to the copayment, coinsurance, deductible, or other enrollee cost-sharing
1.9requirements that apply under the health plan. Cost-sharing requirements for private duty
1.10nursing services must not place a greater financial burden on the insured or enrollee than
1.11those requirements applied by the health plan to other similar services.
1.12EFFECTIVE DATE.This section is effective July 1, 2010, and applies to health
1.13plans offered, sold, issued, or renewed on or after that date.
