1.2Delete everything after the enacting clause and insert:

1.3    "Section 1. Minnesota Statutes 2008, section 181.58, is amended to read:
1.4181.58 SURVIVING SPOUSE OR DOMESTIC PARTNER PAID WAGES
1.5DUE.
1.6    Subdivision 1. Employer. For the purposes of this section the word "employer"
1.7includes every person, firm, partnership, corporation, the state of Minnesota, all political
1.8subdivisions, and all municipal corporations.
1.9    Subd. 2. Domestic partners. "Domestic partners" means two persons who:
1.10(1) are the same sex;
1.11(2) are adults and mentally competent to enter into legally binding contracts;
1.12(3) have assumed responsibility for each other's basic common welfare, financial
1.13obligations, and well-being;
1.14(4) share a common domicile and primary residence with each other on a permanent
1.15basis;
1.16(5) have a committed interdependent relationship with each other, intend to continue
1.17that relationship indefinitely, and do not have this type of relationship with any other
1.18person;
1.19(6) are not married to another person and have not entered into a domestic
1.20partnership arrangement with another person that is currently in effect; and
1.21(7) are not related by blood or adoption so that a marriage between them would be
1.22prohibited under section 517.03, subdivision 1, paragraph (a), clause (2) or (3).
1.23    Subd. 3. Paid wages due. If, at the time of the death of any person, an employer
1.24is indebted to the person for work, labor, or services performed, and no personal
1.25representative of the person's estate has been appointed, such employer shall, upon the
1.26request of the surviving spouse or domestic partner, forthwith pay this indebtedness,
2.1in such an amount as may be due, not exceeding the sum of $10,000, to the surviving
2.2spouse or domestic partner. The employer may in the same manner provide for payment
2.3to the surviving spouse or domestic partner of accumulated credits under the vacation or
2.4overtime plan or system maintained by the employer. The employer shall require proof
2.5of claimant's relationship to decedent by affidavit, and require claimant to acknowledge
2.6receipt of such payment in writing. Any payments made by the employer pursuant
2.7to the provisions of this section shall operate as a full and complete discharge of the
2.8employer's indebtedness to the extent of the payment, and no employer shall thereafter be
2.9liable therefor to the decedent's estate or the decedent's personal representative thereafter
2.10appointed. Any amounts so received by a spouse or domestic partner shall be considered
2.11in diminution of the allowance to the spouse or domestic partner under section 524.2-403.

2.12    Sec. 2. Minnesota Statutes 2008, section 181.947, subdivision 1, is amended to read:
2.13    Subdivision 1. Definitions. (a) The definitions in this subdivision apply to this
2.14section.
2.15(b) "Active service" has the meaning given in section 190.05, subdivision 5.
2.16(c) "Domestic partners" has the meaning given in section 181.58, subdivision 2.
2.17(c) (d) "Employee" means a person, independent contractor, or person working for
2.18an independent contractor who performs services for compensation, in whatever form, for
2.19an employer.
2.20(d) (e) "Employer" means a person or entity located or doing business in this state
2.21and having one or more employees, and includes the state and all political or other
2.22governmental subdivisions of the state.
2.23(e) (f) "Immediate family member" means a person's parent, child, grandparents,
2.24siblings, or spouse or domestic partner.

2.25    Sec. 3. Minnesota Statutes 2008, section 181.947, is amended by adding a subdivision
2.26to read:
2.27    Subd. 5. Notice. An employee must provide the name, address, and phone number
2.28of a domestic partner to the employer.

2.29    Sec. 4. Minnesota Statutes 2008, section 181.948, subdivision 1, is amended to read:
2.30    Subdivision 1. Definitions. (a) For the purposes of this section, the following terms
2.31have the meanings given in this subdivision.
2.32(b) "Active service" has the meaning given in section 190.05, subdivision 5.
2.33(c) "Domestic partner" has the meaning given in section 181.58, subdivision 2.
3.1(c) (d) "Employee" means a person who performs services for compensation, in
3.2whatever form, for an employer. Employee does not include an independent contractor.
3.3(d) (e) "Employer" means a person or entity located or doing business in this state
3.4and having one or more employees, and includes the state and all political or other
3.5governmental subdivisions of the state.
3.6(e) (f) "Immediate family member" means a person's grandparent, parent, legal
3.7guardian, sibling, child, grandchild, spouse or domestic partner, fiance, or fiancee.

3.8    Sec. 5. Minnesota Statutes 2008, section 181.948, is amended by adding a subdivision
3.9to read:
3.10    Subd. 3. Notice. An employee must provide the name, address, and phone number
3.11of a domestic partner to the employer."
3.12Delete the title and insert:
3.13"A bill for an act
3.14relating to employment; modifying benefits;amending Minnesota Statutes 2008,
3.15sections 181.58; 181.947, subdivision 1, by adding a subdivision; 181.948,
3.16subdivision 1, by adding a subdivision."
