1.3Page 49, after line 31, insert:

1.4    "Sec. 33. PERSISTENTLY LOWEST-ACHIEVING SCHOOL DESIGNATION;
1.5FEDERAL SCHOOL IMPROVEMENT GRANTS.
1.6For purposes of federal school improvement grants under the American Recovery
1.7and Reinvestment Act, and unless the chief administrator of a school voluntarily agrees to
1.8the designation in writing, the department must not use a school's high school graduation
1.9rate as a basis to designate a school as a persistently lowest-achieving school if at least 70
1.10percent of the students enrolled in the school are two or more years older than the average
1.11statewide age of other students enrolled in the same grade, lack a sufficient number of high
1.12school credits to graduate on time, or are otherwise eligible to participate in the graduation
1.13incentives program under Minnesota Statutes, section 124D.68.
1.14EFFECTIVE DATE.This section is effective the day following final enactment
1.15and applies retroactively to January 1, 2010."
1.16Renumber the sections in sequence and correct the internal references
1.17Amend the title accordingly
