1.3Page 58, after line 7, insert:

1.4    "Sec. 50. Minnesota Statutes 2008, section 216H.10, subdivision 7, is amended to read:
1.5    Subd. 7. High-GWP greenhouse gas. "High-GWP greenhouse gas" means
1.6hydrofluorocarbons, perfluorocarbons, and sulfur hexafluoride, nitrous trifluoride, and any
1.7other gas the agency deems to have a high global warming potential.

1.8    Sec. 51. Minnesota Statutes 2008, section 216H.11, is amended to read:
1.9216H.11 HIGH-GWP GREENHOUSE GAS REPORTING.
1.10    Subdivision 1. Gas manufacturers. Beginning October 1, 2008, and each year
1.11thereafter, a manufacturer of a high-GWP greenhouse gas must report to the agency the
1.12total amount of each high-GWP greenhouse gas sold to a purchaser in this state during
1.13the previous year.
1.14    Subd. 2. Purchases. Beginning October 1, 2008, and each year thereafter, a person
1.15in this state who purchases 500 10,000 metric tons or more carbon dioxide equivalent of a
1.16high-GWP greenhouse gas for use or retail sale in this state must report to the agency, on a
1.17form prescribed by the commissioner, the total amount of each high-GWP greenhouse gas
1.18purchased for use or retail sale in this state during the previous year and the purpose for
1.19which the gas was used. The commissioner may adopt rules under chapter 14 to establish
1.20a different reporting threshold or to adopt specific reporting requirements for commercial
1.21or industrial facilities that purchase high-GWP gases for use or retail sale in this state.
1.22    Subd. 3. Acceptance of federal filing. With the approval of the commissioner, this
1.23section may be satisfied by filing with the commissioner a copy of a greenhouse gas
1.24emissions report filed with a federal agency or a regional or national greenhouse gas
1.25registry, provided that the entity with which the report is filed requires the emissions
1.26data to be verified."
