1.3    "Sec. 20. Minnesota Statutes 2008, section 62A.3099, subdivision 18, is amended to
1.4read:
1.5    Subd. 18. Medicare supplement policy or certificate. "Medicare supplement
1.6policy or certificate" means a group or individual policy of accident and sickness insurance
1.7or a subscriber contract of hospital and medical service associations or health maintenance
1.8organizations, other than those policies or certificates covered by section 1833 of the
1.9federal Social Security Act, United States Code, title 42, section 1395, et seq., or an issued
1.10policy under a demonstration project specified under amendments to the federal Social
1.11Security Act, which is advertised, marketed, or designed primarily as a supplement to
1.12reimbursements under Medicare for the hospital, medical, or surgical expenses of persons
1.13eligible for Medicare or as a supplement to Medicare Advantage Plans established under
1.14Medicare Part C. "Medicare supplement policy" does not include Medicare Advantage
1.15plans established under Medicare Part C, outpatient prescription drug plans established
1.16under Medicare Part D, or any health care prepayment plan that provides benefits under an
1.17agreement under section 1833(a)(1)(A) of the Social Security Act.

1.18    Sec. 21. Minnesota Statutes 2008, section 62A.31, subdivision 1, is amended to read:
1.19    Subdivision 1. Policy requirements. No individual or group policy, certificate,
1.20subscriber contract issued by a health service plan corporation regulated under chapter
1.2162C, or other evidence of accident and health insurance the effect or purpose of which
1.22is to supplement Medicare coverage, including to supplement coverage under Medicare
1.23Advantage Plans established under Medicare Part C, issued or delivered in this state
1.24or offered to a resident of this state shall be sold or issued to an individual covered by
1.25Medicare unless the requirements in subdivisions 1a to 1u are met."
