1.3Page 1, delete section 1 and insert:

1.4    "Section 1. Minnesota Statutes 2008, section 121A.03, is amended to read:
1.5121A.03 MODEL POLICY.
1.6    Subdivision 1. Model School board policy; prohibiting harassment, bullying,
1.7intimidation, and violence. The commissioner shall maintain and make available to
1.8school boards a model sexual, religious, and racial harassment, bullying, intimidation,
1.9and violence policy. The model policy shall address the requirements of subdivision 2,
1.10and may encourage violence prevention and character development education programs,
1.11consistent with section 120B.232, subdivision 1, to prevent and reduce policy violations.
1.12    Subd. 2. Sexual, religious, and racial Harassment, bullying, intimidation, and
1.13violence policy. (a) A school board must adopt a written sexual, religious, and racial
1.14harassment and sexual, religious, and racial violence policy that conforms, consistent with
1.15chapter 363A, including section 363A.13, and this section that prohibits harassment,
1.16bullying, intimidation, and violence based on characteristics such as actual or perceived
1.17race, color, creed, religion, national origin, sex, marital status, disability, socioeconomic
1.18status, sexual orientation, gender identity or expression, age, physical characteristics,
1.19and association with a person or group with one or more of these actual or perceived
1.20characteristics. The policy shall:
1.21(1) address all forms of harassment, bullying, intimidation, and violence, including
1.22electronic forms and forms involving Internet use, among other forms;
1.23(2) apply to pupils, teachers, administrators, and other school personnel,;
1.24(3) include reporting procedures,; and
1.25(4) set forth disciplinary actions that will be taken for violation of the policy.
1.26Disciplinary actions must conform with collective bargaining agreements and sections
1.27121A.41 to 121A.56. The policy must be conspicuously posted throughout each school
2.1building, posted on the district's Web site, given to each district employee and independent
2.2contractor at the time of entering into the person's employment contract, and included in
2.3each school's student handbook on school policies. Each school must develop a process
2.4for discussing the school's sexual, religious, and racial harassment, bullying, intimidation,
2.5and violence policy with students and school employees. School employees shall receive
2.6training on preventing and responding to harassment, bullying, intimidation, and violence;
2.7the training must reflect what is age-appropriate policy for the school's students.
2.8(b) The school board policy under paragraph (a) also must address student and
2.9staff hazing and include reporting procedures and disciplinary consequences for hazing,
2.10consistent with section 121A.69.
2.11    Subd. 3. Submission to commissioner. Each school board must submit to the
2.12commissioner a copy of the sexual, religious, and racial harassment and sexual, religious,
2.13and racial violence policy the board has adopted under subdivision 2."
