1.3Page 26, after line 35, insert:

1.4    "Sec. 10. Minnesota Statutes 2008, section 121A.035, subdivision 2, is amended to
1.5read:
1.6    Subd. 2. School district and charter school policy. A school board and a
1.7charter school must adopt a crisis management policy to address potential violent crisis
1.8situations in the district or charter school. The policy must be developed cooperatively
1.9with administrators, teachers, employees, students, parents, community members, law
1.10enforcement agencies, other emergency management officials, county attorney offices,
1.11social service agencies, emergency medical responders, and any other appropriate
1.12individuals or organizations. The policy must include at least five four school lock-down
1.13drills, five school fire drills consistent with section 299F.30, and one tornado drill, and an
1.14expectation that students be present and participate in these drills.
1.15EFFECTIVE DATE.This section is effective for the 2009-2010 school year and
1.16later.

1.17    Sec. 11. Minnesota Statutes 2008, section 121A.037, is amended to read:
1.18121A.037 SCHOOL SAFETY DRILLS.
1.19Private schools and educational institutions not subject to section 121A.035 must
1.20have at least five four school lock-down drills, five school fire drills consistent with
1.21section 299F.30, and one tornado drill, and an expectation that students be present and
1.22participate in these drills.
1.23EFFECTIVE DATE.This section is effective for the 2009-2010 school year and
1.24later."
1.25Page 54, after line 22, insert:

1.26    "Sec. 46. Minnesota Statutes 2008, section 299F.30, subdivision 1, is amended to read:
2.1    Subdivision 1. Duties of fire marshal. Consistent with sections 121A.035,
2.2121A.037 , and this section, it shall be the duty of the state fire marshal, deputies and
2.3assistants, to require public and private schools and educational institutions to have at
2.4least five fire drills each school year, to expect students to be present and participate
2.5in these drills, and to keep all doors and exits unlocked from the inside of the building
2.6during school hours.
2.7EFFECTIVE DATE.This section is effective for the 2009-2010 school year and
2.8later."
