1.8    "Sec. 2. [171.45] INTERNET-BASED DRIVER EDUCATION PILOT
1.9PROGRAM.
1.10    Subdivision 1. Pilot program established. (a) The commissioner shall establish
1.11an Internet-based driver education pilot program to authorize and evaluate provision of
1.12the classroom portion of driver education through an Internet-based method of delivery,
1.13as provided in this section. The commissioner shall establish an application process and
1.14requirements for an online driver education provider to provide an Internet-based driver
1.15education course of instruction.
1.16(b) The requirements and fee established by the commissioner under this section are
1.17exempt from the rulemaking provisions of chapter 14, including section 14.386.
1.18    Subd. 2. Application. The pilot program is only available to a student who resides
1.19in (1) one county that is a metropolitan county, as defined in section 473.121, subdivision
1.204, and (2) one county that is not a metropolitan county. The pilot program must initiate on
1.21August 1, 2009, and end on June 30, 2012.
1.22    Subd. 3. Online driver education provider fee. (a) The commissioner shall
1.23institute a fee for each online driver education provider that is approved by the
1.24commissioner to participate in the pilot program. The fee must:
2.1(1) be assessed for each participating provider based on the number of Minnesota
2.2student registrants with the provider who successfully complete the Internet-based driver
2.3education course of instruction;
2.4(2) be in an amount that is reasonably expected to equal (i) the costs of the
2.5department for administration of the pilot program, and (ii) the costs of the legislative
2.6evaluation and report under subdivision 5; and
2.7(3) not exceed $3 per student registrant.
2.8(b) Revenue from the fee must be deposited in the Internet-based driver education
2.9account under subdivision 4.
2.10    Subd. 4. Internet-based driver education account; appropriation. An
2.11Internet-based driver education account is created in the special revenue fund. The
2.12account consists of the fee collected under subdivision 3, and any other money otherwise
2.13donated, allotted, or appropriated to the account. Funds in the account are appropriated to
2.14the commissioner for the pilot program under this section.
2.15    Subd. 5. Pilot program evaluation study and legislative report. By February 15,
2.162012, the commissioner shall submit a report concerning the pilot program to the chairs
2.17and ranking minority members of the house of representatives and senate committees with
2.18jurisdiction over transportation policy and finance. The report must at a minimum:
2.19(1) provide a summary of the pilot program;
2.20(2) include a study that evaluates the effectiveness and impacts of the pilot program;
2.21(3) summarize any updates, findings, or studies on Internet-based driver education
2.22subsequent to those identified in the report required under Laws 2008, chapter 287, article
2.231, section 121; and
2.24(4) provide any departmental recommendations concerning implementation of
2.25Internet-based driver education in Minnesota.
2.26EFFECTIVE DATE.This section is effective July 1, 2009, and expires on June
2.2730, 2012."
