1.2Delete everything after the enacting clause and insert:

1.3    "Section 1. [198.365] VETERANS MENTAL HEALTH FACILITY; KANDIYOHI
1.4COUNTY.
1.5    Subdivision 1. Establishment. (a) The commissioner of veterans affairs shall
1.6establish a 90 bed facility in Kandiyohi County to provide residential mental health
1.7nursing services to veterans, in conformance with licensing rules of the Department of
1.8Health and funding requirements of the United States Department of Veterans Affairs.
1.9(b) Services provided by the facility must include, but not be limited to:
1.10(1) geriatric care for mentally ill veterans who have severe behavior problems;
1.11(2) inpatient treatment, including long term and domiciliary care, for veterans with
1.12traumatic brain injury;
1.13(3) inpatient treatment services, including long term and domiciliary care, for
1.14veterans with post-traumatic stress disorder;
1.15(4) inpatient treatment for veterans with a dual diagnosis of mental illness and
1.16chemical dependency;
1.17(5) long term and domiciliary care for any veteran; and
1.18(6) standard long term care.
1.19(c) To the extent practicable, the facility shall accept referrals from veterans homes
1.20in the state.
1.21    Subd. 2. Funding. (a) The facility must be purchased or built with funds, 65
1.22percent of which must be provided by the federal government, and 35 percent by other
1.23nonstate sources, including local units of government, veterans organizations, business
1.24entities, volunteer organizations, and any other nonstate sources deemed acceptable by
1.25the commissioner. Local contributions must include land for the facility and grounds,
1.26and funding sufficient to cover the full state and local contribution for the federal
2.1matching grant. The commissioner is authorized to accept pledges and funding, including
2.2contributions of land, from these local sources for this purpose.
2.3(b) The commissioner shall seek private funding to develop a public-private
2.4partnership to provide services at this facility for veterans with traumatic brain injury and
2.5with post-traumatic stress disorder, as well as for veterans who have a dual diagnosis of
2.6mental illness and chemical dependency.
2.7(c) The commissioner shall seek all sources of federal funding available for
2.8long-term and domiciliary care, and for treatment of post-traumatic stress disorder and
2.9traumatic brain injury at this facility.
2.10(d) The commissioner shall seek funding from state and federal sources to fund
2.11traumatic brain injury research at this facility.
2.12    Subd. 3. Ownership; lease-buy agreement. Upon completion of construction and
2.13commencement of operations the facility shall be owned by the County or City providing
2.14the majority of the local share funding. The commissioner of administration is authorized
2.15to enter into a 20-year lease-buy back agreement with that local government entity,
2.16following satisfaction of which all ownership shall transfer to the state.
2.17    Subd. 4. Support services. Upon request, the commissioner of human services shall
2.18arrange for the extension of support services to the veterans facility in Willmar including,
2.19but not limited to, the provision of utilities, and kitchen and laundry services.

2.20    Sec. 2. DATE OPERATIONAL.
2.21To the extent practicable, the commissioner of veterans affairs shall design,
2.22construct, furnish and equip the veterans mental health facility authorized in section 1 for
2.23commencement of operations on July 1, 2013. No state general fund monies may be
2.24expended for operational costs for this facility without further legislative authorization,
2.25and in no event, prior to that date.

2.26    Sec. 3. EFFECTIVE DATE.
2.27Sections 1 and 2 are effective the day following final enactment."
2.28Delete the title and insert:
2.29"A bill for an act
2.30relating to veterans; establishing a veterans' mental health facility in Kandiyohi
2.31County; specifying services to be provided; directing the commissioner of
2.32veterans affairs to apply for federal funding, and authorizing the commissioner
2.33to accept local matching funding for the facility; prohibiting commencement of
2.34operations prior to fiscal year 2014;proposing coding for new law in Minnesota
2.35Statutes, chapter 198."
