1.6student instruction the board formally adopted as its school calendar at the beginning of
1.7the 1996-1997 school year 425 hours of instruction for a kindergarten student without a
1.8disability, 935 hours of instruction for a student in grades 1 through 6, and 1,020 hours of
1.9instruction for a student in grades 7 through 12, not including summer school."

1.11    "Sec. 4. Minnesota Statutes 2009 Supplement, section 124D.10, subdivision 13,
1.12is amended to read:
1.13    Subd. 13. Length of school year. A charter school must provide instruction each
1.14year for at least the number of days hours required by section 120A.41. It may provide
1.15instruction throughout the year according to sections 124D.12 to 124D.127 or 124D.128."

1.17    "Sec. 8. [127A.431] REDUCTION OF AID FOR NOT PROVIDING REQUIRED
1.18HOURS OF INSTRUCTION.
1.19The commissioner shall reduce the state aid paid to a school district or charter school
1.20that does not provide instruction for at least the number of hours required under section
1.21120A.41. If instruction is not provided for the required number of hours, state aid shall be
1.22reduced by the difference between the required number of hours and the number of hours
1.23instruction is provided, divided by the required number of hours, multiplied by 60 percent
1.24of the basic revenue, as defined in section 126C.10, subdivision 2, of the district or charter
1.25school for that year. However, a district or charter school not providing the required
1.26number of hours may appeal to the commissioner for a waiver of the state aid reduction
2.1if (1) the circumstances causing loss of instructional time below the required minimum
2.2number of hours are beyond the control of the board, and (2) a good faith attempt is made
2.3to make up time lost due to these circumstances."
