1.2Delete everything after the enacting clause and insert:

1.3    "Section 1. [35.086] BOVINE TUBERCULOSIS MANAGEMENT ZONE;
1.4RESTRICTIONS.
1.5    Subdivision 1. Definitions. (a) The definitions in this subdivision apply to this
1.6section.
1.7    (b) "Bovine tuberculosis management zone" means the area within the ten-mile
1.8radius around the five presumptive tuberculosis-positive deer sampled during the fall
1.92006 hunter-harvested surveillance effort.
1.10    (c) "Located within" means that the herd is kept in the area for at least a part of
1.11the year.
1.12    Subd. 2. Requirements. (a) Cattle owners with herds located within the bovine
1.13tuberculosis management zone must:
1.14    (1) apply to the board for payments to remove the herd from the farm and keep off
1.15the farm until the modified accredited area achieves tuberculosis-free status; or
1.16    (2) demonstrate that the cattle herd is kept in a manner that does not allow cattle
1.17and deer interface.
1.18    (b) All farms located within the bovine tuberculosis management zone must be kept
1.19in a manner that does not allow deer access.

1.20    Sec. 2. Minnesota Statutes 2007 Supplement, section 35.244, is amended to read:
1.2135.244 RULES FOR CONTROL OF BOVINE TUBERCULOSIS.
1.22    Subdivision 1. Designation of zones. The board has the authority to control
1.23tuberculosis and the movement of cattle, bison, and farmed cervidae within and between
1.24tuberculosis zones in the state. Zones within the state may be designated as accreditation
1.25preparatory, modified accredited, modified accredited advanced, or accredited free as
2.1those terms are defined in Code of Federal Regulations, title 9, part 77. The board may
2.2designate tuberculosis zones that contain not more than 201 herds.
2.3    Subd. 2. Control within modified accredited zone. In a modified accredited
2.4zone, the board has the authority to:
2.5    (1) require owners of cattle, bison, or farmed cervidae to report personal contact
2.6information and location of livestock to the board;
2.7    (2) require a permit or movement certificates for all cattle, bison, and farmed
2.8cervidae moving between premises within the zone or leaving or entering the zone;
2.9    (3) require official identification of all cattle, bison, and farmed cervidae within
2.10the zone or leaving or entering the zone;
2.11    (4) require a negative tuberculosis test within 60 days prior to movement for any
2.12individual cattle, bison, or farmed cervidae leaving the zone with the exception of cattle
2.13moving under permit directly to a slaughter facility under state or federal inspection;
2.14    (5) require a whole-herd tuberculosis test within 12 months prior to moving breeding
2.15cattle out of the zone;
2.16    (6) require annual herd inventories on all cattle, bison, or farmed cervidae herds; and
2.17    (7) require that a risk assessment be performed to evaluate the interaction of
2.18free-ranging deer with cattle, bison, and farmed cervidae herds and require the owner to
2.19implement the recommendations of the risk assessment.
2.20    Subd. 3. Authority to adopt rules. The board may adopt rules to provide for the
2.21control of tuberculosis in cattle. The rules may include provisions for quarantine, tests,
2.22and such other measures as the board deems appropriate. Federal regulations, as provided
2.23by Code of Federal Regulations, title 9, part 77, and the Bovine Tuberculosis Eradication
2.24Uniform Methods and Rules, are incorporated as part of the rules in this state.

2.25    Sec. 3. APPROPRIATION; BOVINE TUBERCULOSIS MANAGEMENT ZONE
2.26HERD BUYOUT.
2.27    $3,000,000 is appropriated in fiscal year 2009 from the general fund to the Board
2.28of Animal Health for the payments to cattle owners who remove cattle herds that are
2.29located within the bovine tuberculosis management zone, as defined in Minnesota
2.30Statutes, section 35.086.

2.31    Sec. 4. PASTURE RESEARCH.
2.32    $....... is appropriated in fiscal year 2009 from the general fund to the Board of
2.33Animal Health for a grant to North Central Research Center at Grand Rapids for a study of
2.34the lifecycle of bovine tuberculosis in pasture."
2.35Amend the title accordingly
