1.4    "Sec. .... Minnesota Statutes 2006, section 3.30, subdivision 1, is amended to read:
1.5    Subdivision 1. Appropriation; transfers. A general contingent appropriation for
1.6each year of the biennium is authorized in the amount the legislature deems sufficient.
1.7Additional special contingent appropriations as the legislature deems necessary are
1.8authorized. Transfers from the appropriations to the appropriations of the various
1.9departments and agencies may be made by the commissioner of finance subject to the
1.10following provisions:
1.11    (a) Transfers may be authorized by the commissioner of finance not exceeding
1.12$5,000 for the same purpose for any quarterly period.
1.13    (b) Transfers exceeding $5,000 but not exceeding $10,000 may be authorized by the
1.14commissioner of finance with the approval of the governor.
1.15    (c) Transfers exceeding $10,000 may be authorized by the governor but no transfer
1.16exceeding $10,000 may be made until the governor has consulted the Legislative Advisory
1.17Commission and it has made its recommendation on the transfer. Its recommendation
1.18is advisory only. Failure or refusal of the commission to make a recommendation is
1.19a negative recommendation. Subject to the provisions in this paragraph, the governor
1.20may request a transfer to the commissioner of agriculture to pay for activities to respond
1.21promptly to an outbreak of an invasive tree pest. The commissioner of agriculture shall
1.22report to the commissioner of finance all potential sources of reimbursement for costs
1.23incurred including but not limited to federal funds.
1.24    The commissioner of finance shall return to the appropriate contingent account any
1.25funds transferred under this subdivision that the commissioner determines are not needed."
