1.3Page 34, after line 19 insert:

1.4    "Section 1. Minnesota Statutes 2007 Supplement, section 256.01, subdivision 2b,
1.5is amended to read:
1.6    Subd. 2b. Performance payments; performance measurement. (a) The
1.7commissioner shall develop and implement a pay-for-performance system to provide
1.8performance payments to eligible medical groups and clinics that demonstrate optimum
1.9care in serving individuals with chronic diseases who are enrolled in health care
1.10programs administered by the commissioner under chapters 256B, 256D, and 256L.
1.11The commissioner may receive any federal matching money that is made available
1.12through the medical assistance program for managed care oversight contracted through
1.13vendors, including consumer surveys, studies, and external quality reviews as required
1.14by the federal Balanced Budget Act of 1997, Code of Federal Regulations, title 42, part
1.15438-managed care, subpart E-external quality review. Any federal money received
1.16for managed care oversight is appropriated to the commissioner for this purpose. The
1.17commissioner may expend the federal money received in either year of the biennium.
1.18    (b) Effective July 1, 2009, or upon federal approval, whichever is later, the
1.19commissioner shall develop and implement a patient incentive health program to provide
1.20incentives and rewards to patients who are enrolled in health care programs administered
1.21by the commissioner under chapters 256B, 256D, and 256L, and who have agreed to and
1.22have met personal health goals established with the patients' primary care providers to
1.23manage a chronic disease or condition, including but not limited to diabetes, high blood
1.24pressure, and coronary artery disease.
1.25    (c) The commissioner may release, upon request, summary data as defined in section
1.2613.02, subdivision 19, on claims and utilization for medical assistance, general assistance
1.27medical care, and MinnesotaCare enrollees at no charge to the University of Minnesota
2.1Medical School, the Mayo Medical School, Northwestern Health Sciences University, the
2.2Institute for Clinical Systems Improvement, and other research institutions, to conduct
2.3analyses of health care outcomes and treatment effectiveness, provided the research
2.4institutions do not release private or nonpublic data, or data for which dissemination is
2.5prohibited by law."
2.6Renumber the sections in sequence and correct the internal references
2.7Amend the title accordingly
