1.4    "Section 1. Minnesota Statutes 2006, section 169.01, subdivision 75, is amended to
1.5read:
1.6    Subd. 75. Commercial motor vehicle. (a) "Commercial motor vehicle" means a
1.7motor vehicle or combination of motor vehicles used to transport passengers or property if
1.8the motor vehicle:
1.9    (1) has a gross vehicle weight of more than 26,000 pounds;
1.10    (2) has a towed unit with a gross vehicle weight of more than 10,000 pounds and the
1.11combination of vehicles has a combined gross vehicle weight of more than 26,000 pounds;
1.12    (3) is a bus;
1.13    (4) is of any size and is used in the transportation of hazardous materials that are
1.14required to be placarded under Code of Federal Regulations, title 49, parts 100-185; or
1.15    (5) is outwardly equipped and identified as a school bus, except for type A-I and
1.16type III school buses as defined in subdivision 6.
1.17    (b) For purposes of chapter 169A:
1.18    (1) a commercial motor vehicle does not include a farm truck, an authorized
1.19emergency vehicle, or a recreational vehicle being operated by a person within the scope
1.20of section 171.02, subdivision 2, paragraph (b); and
1.21    (2) a commercial motor vehicle includes a vehicle capable of or designed to meet the
1.22standards described in paragraph (a), clause (2), whether or not the towed unit is attached
1.23to the truck-tractor at the time of the violation or stop."

1.25    "Sec. 3. Minnesota Statutes 2006, section 169.448, subdivision 1, is amended to read:
2.1    Subdivision 1. Restrictions on appearance; misdemeanor. (a) A bus that is not
2.2used as a school bus may not be operated on a street or highway unless it is painted a color
2.3significantly different than national school bus glossy yellow.
2.4    (b) A bus that is not used as a school bus or Head Start bus may not be operated if it
2.5is equipped with school bus or Head Start bus-related equipment and printing.
2.6    (c) A violation of this subdivision is a misdemeanor.
2.7    (d) This subdivision does not apply to a school bus owned by or under contract to a
2.8school district operated as a charter or leased bus.
2.9    (e) This subdivision does not apply to a school bus operated by a licensed child
2.10care provider if:
2.11    (1) the stop arm is removed;
2.12    (2) the eight-light system is deactivated;
2.13    (3) the school bus is identified as a "child care bus" in letters at least eight inches
2.14high on the front and rear top of the bus; and
2.15    (4) the name, address, and telephone number of the owner or operator of the bus is
2.16identified on each front door of the bus in letters not less than three inches high; and.
2.17    (5) the conditions under section 171.02, subdivision 2a, paragraph (b), clauses (1)
2.18through (10), (12), and (14), have been met."

2.20    "Sec. 5. Minnesota Statutes 2007 Supplement, section 171.02, subdivision 2, is
2.21amended to read:
2.22    Subd. 2. Driver's license classifications, endorsements, exemptions. (a) Drivers'
2.23licenses are classified according to the types of vehicles that may be driven by the holder
2.24of each type or class of license. The commissioner may, as appropriate, subdivide the
2.25classes listed in this subdivision and issue licenses classified accordingly.
2.26    (b) Except as provided in paragraph (c), clauses (1) and (2), and subdivision 2a, no
2.27class of license is valid to operate a motorcycle, school bus, tank vehicle, double-trailer
2.28or triple-trailer combination, vehicle transporting hazardous materials, or bus, unless
2.29so endorsed. There are four general classes of licenses as described in paragraphs (c)
2.30through (f).
2.31    (c) Class D drivers' licenses are valid for:
2.32    (1) operating all farm trucks if the farm truck is:
2.33    (i) controlled and operated by a farmer, including operation by an immediate family
2.34member or an employee of the farmer;
2.35    (ii) used to transport agricultural products, farm machinery, or farm supplies,
2.36including hazardous materials, to or from a farm;
3.1    (iii) not used in the operations of a common or contract motor carrier as governed by
3.2Code of Federal Regulations, title 49, part 365; and
3.3    (iv) used within 150 miles of the farm;
3.4    (2) notwithstanding paragraph (b), operating an authorized emergency vehicle,
3.5as defined in section 169.01, subdivision 5, whether or not in excess of 26,000 pounds
3.6gross vehicle weight;
3.7    (3) operating a recreational vehicle as defined in section 168.011, subdivision 25,
3.8that is operated for personal use;
3.9    (4) operating all single-unit vehicles except vehicles with a gross vehicle weight of
3.10more than 26,000 pounds, vehicles designed to carry more than 15 passengers including
3.11the driver, and vehicles that carry hazardous materials;
3.12    (5) notwithstanding paragraph (d), operating a type A school bus or a multifunctional
3.13school activity bus without a school bus endorsement if:
3.14    (i) the bus has a gross vehicle weight of 10,000 pounds or less;
3.15    (ii) the bus is designed to transport 15 or fewer passengers, including the driver; and
3.16    (iii) the requirements of subdivision 2a are satisfied, as determined by the
3.17commissioner;
3.18    (6) operating any vehicle or combination of vehicles when operated by a licensed
3.19peace officer while on duty; and
3.20    (7) (6) towing vehicles if:
3.21    (i) the towed vehicles have a gross vehicle weight of 10,000 pounds or less; or
3.22    (ii) the towed vehicles have a gross vehicle weight of more than 10,000 pounds and
3.23the combination of vehicles has a gross vehicle weight of 26,000 pounds or less.
3.24    (d) Class C drivers' licenses are valid for:
3.25    (1) operating class D motor vehicles;
3.26    (2) with a hazardous materials endorsement, transporting hazardous materials
3.27in class D vehicles; and
3.28    (3) with a school bus endorsement, operating school buses designed to transport 15
3.29or fewer passengers, including the driver.
3.30    (e) Class B drivers' licenses are valid for:
3.31    (1) operating all class C motor vehicles, class D motor vehicles, and all other
3.32single-unit motor vehicles including, with a passenger endorsement, buses; and
3.33    (2) towing only vehicles with a gross vehicle weight of 10,000 pounds or less.
3.34    (f) Class A drivers' licenses are valid for operating any vehicle or combination of
3.35vehicles."
