1.18    Subd. 1b. Form and delivery of notice. The notice required by this section must

1.20color of the notice of foreclosure and that does not obscure or overshadow the content of
1.21the notice. The title of the notice must be in 20-point boldface type. The notice must be
1.22on its own page. The notice required by this section must be delivered with the notice of
1.23foreclosure required by sections 580.03 and 580.04. The notice required by this section
1.24also must be delivered with each subsequent written communication regarding the
1.25foreclosure mailed to the mortgagor by the foreclosing party up to the day of redemption,
1.26except that a person may not be held liable in an action brought under this section for a
2.1violation of this section for failure to deliver the subsequent notices if the person shows by
2.2a preponderance of evidence that the violation was not intentional and resulted from a bona
2.3fide error notwithstanding the maintenance of procedures reasonably adopted to avoid the
2.4error. A foreclosing mortgagee will be deemed to have complied with this section if it
2.5sends the notice required by this section at least once every 60 days during the period of
2.6the foreclosure process. The notice required by this section must not be published."
