1.3    "Sec. 15. [62U.09] EMPLOYEE SUBSIDIES FOR HEALTH COVERAGE.
1.4    Subdivision 1. Establishment of subsidy program. The commissioner of human
1.5services shall establish a subsidy program for eligible employees and dependents to
1.6provide assistance in purchasing health coverage.
1.7    Subd. 2. Eligible employees and dependents; incomes not exceeding 300 percent
1.8of the federal poverty guidelines. In order to be eligible for a subsidy under this section,
1.9an employee or dependent with a gross household income that does not exceed 300
1.10percent of the federal poverty guidelines must:
1.11    (1) be covered by employer-subsidized health coverage, as defined in section
1.12256L.07, subdivision 2, paragraph (c), that meets the benefits set and design requirements
1.13established under section 62U.04 and is purchased through the Health Insurance Exchange
1.14established under section 62U.02; and
1.15    (2) meet all eligibility criteria for the MinnesotaCare program established under
1.16chapter 256L, except for the requirements related to:
1.17    (i) no access to employer-subsidized coverage under section 256L.07, subdivision
1.182; and
1.19    (ii) no other health coverage under section 256L.07, subdivision 3.
1.20    Subd. 3. Eligible employees and dependents; incomes greater than 300 percent
1.21but not exceeding 400 percent of the federal poverty guidelines. In order to be eligible
1.22for a subsidy under this section, an employee or dependent with a gross household income
1.23that is greater than 300 percent but does not exceed 400 percent of the federal poverty
1.24guidelines must:
2.1    (1) be covered by health coverage that meets the benefits set and design requirements
2.2established under section 62U.04 and is purchased through the Health Insurance Exchange
2.3established under section 62U.02; and
2.4    (2) meet all eligibility criteria for the MinnesotaCare program established under
2.5chapter 256L, except for the requirements related to:
2.6    (i) no access to employer-subsidized coverage under section 256L.07, subdivision 2;
2.7    (ii) no other health coverage under section 256L.07, subdivision 3; and
2.8(iii) gross household income under section 256L.04, subdivisions 1 and 7.
2.9    Subd. 4. Amount of subsidy. The subsidy must equal the amount the employee
2.10is required to pay for health coverage for the employee and any dependents, including
2.11premiums, deductibles, and other cost sharing, minus an amount based on the affordability
2.12standard specified in section 62U.08. The maximum subsidy must not exceed the amount
2.13of the subsidy that would have been provided under the MinnesotaCare program, if the
2.14employee and any dependents were eligible for that program.
2.15    Subd. 5. Payment of subsidy. The commissioner shall pay the subsidy amount
2.16for an employee and any dependents to the Minnesota Health Insurance Exchange, and
2.17this payment shall be credited toward the employee's share of premium. Any additional
2.18amount paid by the commissioner to the Minnesota Health Insurance Exchange that
2.19exceeds the employee's share of premium must be credited first toward the employee
2.20deductible and then toward any employee cost-sharing obligation.
2.21EFFECTIVE DATE.This section is effective July 1, 2010."
